I don't know which category to actually post this under and im just ranting more than asking for help. DAC Report in general is nothing but a complete joke but when something actually goes on it falsely (in my opinion) then I turn to Hire Right to dispute it, it does NO GOOD!. What good does it really do to ask me questions and submit it to the company that put it on their in the 1st place. If Hire Right isn't going to try and help an INNOCENT driver out then it is a waste of time to even offer the dispute option.
I worked for this company before and got a Speeding 15 or more violation (dismissed in court so wasn't on MVR but is on PSP). I wanted to work for them again so applied and they said they would take me back but if I get any more violations in the 1st year of working for them then they will have to let me go so I agreed to it and went back to work for them.
I was on I-5 in Washington and another motorist (car) felt like he needed to mind my business and video tape me for about 10 miles or more. Now this is where it really makes me mad. He called in on me and said I was "speeding" (How in the hell can you say I am speeding when you are in the left lane video taping me in the middle lane and you are slowing down??) Anyways, I got pulled over 7 miles from my destination by some ignorant state patrol. She wrote on an inspection report "speeding" so I had to send it in to the company but she admittedly stated "I don't really know what to do. I had to stop you to be sure you were okay since we got a call in." I was mad already and just wanted to get to the destination and didn't think "speeding" on an inspection report would be a big issue since I wasn't fined anything and she didn't have me on radar at all so I signed the paper and off we went.
I turn it in to the company and I get a call about 4 or 5 days later from the safety manager asking me what happened. I told her and she said "we need to get this taken care of because it sounds like a bunch of bs" She was on my side the WHOLE WAY WITH IT. She said "can you make a written statement so I can try to fight it before it goes on your psp record because we already have alert status so we don't need anymore points going against us" I made the statement and sent it to her.
For all you that follow the PSP, it is updated once a month at the end of every month for the most part so AS SOON AS IT HIT THE PSP REPORT, I go in to get some more log books from the terminal in LA and he says "I need to talk to you but give me a few minutes." I knew exactly what it was. He calls me back in there and says they have to let me go due to safety violations. I didn't really give a care about it at all because it was December 2nd so I went to Vegas and relaxed for the holidays.
After the holidays, I got in touch with Washington State commercial vehicle division and he was dumbfounded as to why it was showing up on the PSP report anyways as he told me, he had no record of it. He told me to fax him the inspection report and he would get it taken care of. 3 days later it was removed from my PSP and it was like nothing ever happened besides I lost my job over NOTHING. I started looking for a job again shortly after New years of 2013 and found out they put "unsatisfactory safety record" on my DAC. I have worked since then at a company and have been accepted by others. The good jobs in my opinion wont talk to me until I have atleast 18 months driving since then and no more safety problems so im pretty much screwed for something that should have never happened in the 1st place.
Bottom Line, If you get screwed badly on your DAC and you didn't do anything, you might as well look for a new career because turning to Hire Right isn't going to get you any where. DAC and PSP are just a way to hurt truckers. If I got a 15 MPH or more speeding ticket in my car and it was dismissed in court, it would be no where to be found but this stupid PSP garbage has everything on it no matter what. No reason to even check the MVR anymore which actually shows what you were CONVICTED of because all employers just go by the PSP. My MVR only has 1 point on it (wrong lane violation). Innocent until proven guilty doesn't matter when it comes to trucking.

You need to sue Hire Right in Federal Court. You can do this yourself. You have to use Pacer to electronically file but you will get your DAC cleaned up. I you cannot figure out how to do this go to a local law school and use their library. Ask for help there. The more folks who do this the less likely Hire Right will be in business.

Okay, so in order for OP to get his DAC cleaned up- is take a massive multi-national corporation to a federal court.
I think that train of logic may be skipping a few alternatives -.- -
I think the OP stated that he had gone through the proper channels with Hire Right. You have to make a complaint with the company in writing. They then send your written statement to the company who then responds with a letter to Hire Right. Hire Right has to receive that letter within a certain time period. If the company stands by their complaint, Hire Right will notify you that they will not remove the remark. So what do you do next. You sue in federal court.
Hire Rights is subject to The Fair Credit Reporting Act (FCRA) 15 USC part 1681
As it is a pretty straight forward lawsuit a person can proceed Pro Se. This allows someone to get their case heard at little cost.
Again, I believe the OP has taken the steps he should have taken. But as an ex Air Force guy, I believe in the use of Nuclear Weapons when you can get their attention any other way.
Hire Right needs to be hauled into court often. What they are doing is taking one side and only one side and putting that out there as the truth. Hire right is not about justice. The courts are. So yes, sue a multi national in court. After all the only nation that counts is the US in this case. We are all equal in the eyes of the law.900,000-tons-of-steel Thanks this. -
IMO, I don't believe the part about faxing an officer your inspection report and he removed the remark for you. I haven't heard one success story yet in regards to someone getting something removed from their PSP. It takes an act of congress and an appeal process to get something removed from it. That would mean your company still had hard evidence and a reason to report to DAC. With a dispute HireRight would of removed the mark unless the company proved otherwise with hard written evidence. So they do have something.
I would pay $10 online and get a copy of your PSP. Then you aren't relying on someones word.

CondoCruiser, it was removed. I checked it before and after and just again recently just to see what all is on their. It must not take much to get it removed if it shouldn't have been on their in the 1st place. On the flip side, I disputed the speeding 15 or more that I got and I couldn't get that removed even though it was dismissed in court. Anyways, that is the point im trying to make, THERE IS NO WAY YOU CAN GET ANYTHING OFF OF THE PSP UNLESS IT IS FLAT OUT FALSE! That is why im saying, the unsatisfactory safety record is on my DAC for a false reason and I cant get anything taken care of because as long as the company chooses for it to be, then that is what it is going to be.
Yea, I learned one thing. There are some very ignorant people on the west coast. -

Let me restate that. I have signed inspection forms before. But I would not have signed on that stated that I was speeding. If I was speeding, I would have been given a violation, with a court date, docket number, and some courthouse, and a phone number.
See, there are procedures that have to be followed, one of which is where that sworn officer has to eyewitness, or have the eyewitness fill out a statement. The eyewitness' accusation of you speeding doesn't mean jack.The videotape of you going down the highway filmed by a motorist doesn't mean jack. No one had proof of excessive speed.That's why there was no violation issued by the LEO. When called, the LEO will make a traffic stop.
