Hiring Owner Operators Question

    Hello,

    I've been running under my own authority for 6 years now and I'm interested in leasing owner operators. I have some questions and concerns before I start posting ads and looking around. I have a drug testing plan in place, and a lease agreement put together. Which I have attached so you could take a look at. Also when I hire my first Owner Operator who do I report it to if anyone? I know the MCS 150 form and UCR as for this info but where else would I report it to.

    The FMCSA has a driver qualification checklist for new drivers, does an O/O need to complete that also?

    Finally, if and Owner Operator quits or I terminate the agreement what steps to do I take. My fear is if I fire an owner operator they may continue to drive under my signs.

    Just make sure your insurance carrier will approve them. Is all you really need to do. You seem to have the other steps you need in order.

    If you are concerned about them running under your numbers if they leave I impose a $250.00 penalty if they do not return all company property (placards, numbers, fuel card etc.). Most owner operators are professional enough to not run under your numbers if you fire them.

    Also you will wnat to make sure that you conduct a monthly audit on logs for you O/O's and create a letter that you get them sign listing any violations to keep in there employee file. This will go a long way if you get audited by the DOT.

    Sure wish this post would gain some traction. We are running two trucks currently with employee drivers and want to bring (lease) on an O/O as well.

    Any feedback on fair to better pay rates for o/o's?

    You don't need to 'report' the new O/O, just add onto your MCS150 when it is time to update and add to the UCR next January...

    You do need to have a full qualification file for every person driving under your authority. You need to keep the 'terminated' file for a full year afterwards.

    You also need to have some kind of maintenance file on the vehicle that you keep for a year after you stop using the vehicle.

    You should keep an escrow amount [follow the rules!] and use that as leverage to get back the fuel card and door signs.

    Finally learn to monitor your DOT number in the new SMS system and get a password to use Data Q in order to be able to correct any incorrect information that gets on your SMS report since the new system uses ALL the roadside data instead of the Out of Service items that were used in Safe Stat.

    I didn't read your lease, I hope you had help drafting it so it does protect you! Make sure you stay on top of the Fuel taxes and remember you have to report the O/O's 2290 info to Uncle Sam...

    Make sure your insurance is on board with your plans and stick to their guidelines. Be careful about who you lease on...

    where do you faind those loads in florida i'live in fl bat i can't find any loads i have to drive empty to ga evrytime.
