"Clowns To The Left, Jokers To The Right".
The UPSIDE is that The "driver" will have that DEBT follow him/her until it's settled along with the wonderful and pleasant "Collection Activity".
I "tried to run away or hide" from a Debt to A Heavy Equipment Training School (maybe '93 or '94) where I SIGNED A CONTRACT REGARDING TRAINING & PAYMENTS.
Regardless of inability to secure Employment in the field (due to their lack of valid information in the initial Interview), The CONTRACT was "sold" to various Companies/Collection Services across a Decade+, until it was satisfied at an egregiously LARGER AMOUNT.

I would like to see a copy of the signed contract before damning the driver. If there is an option to repay all or a portion of the reputed extensive cost of the training, it may be moot on going elsewhere. Start new job, make payment to Hirschbach. Start new job, now employed.. Make loan and pay in full. At worst he is just past due on a note. I did not see where they claimed he had refused to pay or attempt to reconcile the agreement. More of a sour grapes that he elected to leave for another. That says a lot about the situation from his viewpoint. If I was the receiver of a letter like that, I would tell them to Grab it and Growl. I did not lure him. He applied and we are processing. Take your best shot. I do not suffer threats via mail. Come down to my place and clarify your intentions.Eagle 89, gentleroger, Lonesome and 2 others Thank this. -
the letter implies that another trucking company is attempting to recruit the driver .
Which indicates the driver is still employed at the first company .
if the driver signs a loan agreement for the training and leaves , then the company can sue the driver , but that takes months or years now with covid and there’s always the chance that a jury would find foe the driver and rule against the company and they company is afraid to take that chance .
The company should be sending a much more polite letter to the driver with a copy of the loan contract reminding the driver that if they leave they have to pay it back .
since most companies have a sign on bonus . I’m sure there are Plenty of companies that would pay off the training loan as a sign on bonus .gentleroger, Badmon, Oxbow and 1 other person Thank this. -

pretty sad a company has to send a cease and desist letter with really no ground to work off of.. this is a baseless threat that really would never go anywhere.... i would send them a letter back telling them to cease and desist from sending me cease and desist letters, or i will threaten legal action.

And most non compete clauses are unenforceable….gentleroger, JolliRoger, Tall Mike and 1 other person Thank this. -
Like Creditors Do, Place A Lien On Driver Credit Report As A (Purchase) Contract Is A Legal Document.

I’d be ok with them sending a letter just advising the prospective company that the driver is under contract, but I think the threat of legal action is a little extreme for something that should be between Hirschbach and the driver.Lonesome Thanks this.
