In Texas if you get into any litigation with an HOA you have to pay their legal fees, even if you win your case. Seedy lawyers will sometimes cruise neighborhoods and file suits on behalf of HOA's without even telling the HOA. In my opinion, such legal privileges have allowed some HOA's to turn into little banana republics.

So true. There are cases where an HOA has legally placed liens, and even sold people's houses for unpaid fines, or dues. All in the HOA bylaws you signed. It's just another example of power corrupting people.
