Adverse driving conditions. Had a dot in utah tell me as long as the national weather service is in business. It is your responsibility to check it . If you end up in the mountains and you gotta stop because they shut interstate down. You go past ur 14 rule you get a ticket. You was warned of the weather conditions before you commited yourself to the trip. Revenue collectors have an excuse for everything

 

Well, yeah! They'd be pretty piss-poor revenue collectors if they didn't!

 

Yes , they can change them - and get caught during an audit .

 

A company can not legally change anything on your logs. And the sad thing is that, you the driver, would be charged with operating with a falsified logs if stopped or had been in a accident. The company would get a small fine for the offense but you the driver would have paid the price big time. It is not the companies log book but the drivers log book and you are responsible. And the company will deny everything and watch you take the blame. Drivers don't fall for your dispatchers ignorance because you will be the one on the hook.

 

remember, 24 hrs. in 1 day...period.......consecutive is a key word.......you must have 10 consecutive hrs. OFF or BERTH or combo..of 10 consecutive....you are only allowed 11 hours drive time....period.....and that leaves 3 hrs. for on duty not driving work...where applicable. After your 10, remember...when you do that 15 pre trip...THAT starts your day...where you start....til 11 driving or 14 total...ends it...then you MUST TAKE 10 OFF... (hope that helps)

 

"Had been" he still has 6 months to be concerned with that one log and definately the next 30 days if in ANY accident with the tractor.

It's legal to request a driver to submit a "true and accurate" log, however it's not legal for ANYONE (driver or company representative) to edit/change their driving time, when they was actually driving the truck for work related purpose from driving to not driving.
If you was not under dispatch and not hauling a trailer, maybe they allowed you to use the truck for personal use and now that might be a case to legally help you.

I don't know both sides of the stories/conversations to and from dm/driver but that's both scenarios I can think of.

Never allow anyone to edit or change your logs to reflect ANY duty status that you WAS NOT doing. Make sure you clearly understand off duty/sleeper/driving/on-duty not driving and Off duty driving (if using electronic logs) before you assume you are right though. I had many drivers accuse us of doing wrong, when in actuality, we was only helping the driver log the CORRECT duty status Have a great night

 

The way I understood that was, you could drive over your 11 an extra 2 because of weather as long as it doesn't go over your 14 clock.

Nothing to really worry about at this point due to the implementation date being so far out. There will undoubtedly be legal challenges to this latest round of rule making which will probably put the new rules on hold indefinitely.

Gotta love our legal system. Don't like the rules? SUE!

 

The "On Duty Time", Penalties, and Oil Field Exemption Provisions /changes go into affect Feb. 27, 2012 Looks like it might help team drivers?? And now I'll be able to "legally" be in my truck lounging around etc. and log it as "Off Duty"
