    I thought they changed it to 8. Haven't had to log for a while so I haven't been paying much attention to their rule changing shenanigans.

    7 days prior to today + today = 8 days.

    If you've put in 65 hours on duty in the 7 days prior to today, you have 5 hours to work with today.

    My point was just that you can do this calculation every morning for your entire career and never take a reset. Nobody cares if you take a reset or not... nobody cares if you're on duty not driving 24 hours a day... just that you don't drive if your 70hrs/8days is used up.

    I was working in the oilfield when the new rules came on. We very, very carefully clarified what applied and what didn't. The 1/2 hr break applies, but the only-once-a-week-restart provision doesn't. The 24 hr restart provision for the oilfield is written into law, whereas the new rules are just that...rules issued by a regulating body. The FMCSA rules can't supersede the law, therefore anytime an oilfield worker has 24 consecutive hours off-duty, it qualifies as a restart

    Our safety person says either 34hr or 24hr can only be used once a week now. We run under the oilfield exemption rules. So could you please clarify when you say law, State law or Federal law ? Also a link to your law, would be helpful.

    Most states have "written into law" a statute that goes something like this:

    It is unlawful for any person to operate any commercial motor vehicle in this state unless such vehicles are equipped and operated as required by Parts 390 through 397, Title 49, Code of Federal Regulations, as such regulations have been and may periodically be amended.

    State LAW adopts the REGULATIONS, therefore when you are in violation of the regulations (rules), you are in violation of the law.

    So, if I had a 34 reset 6 days ago, do I still recover my hours from 8 days ago? Im assuming no, because they were worked before the reset, but it'd be pretty convenient at the moment if I did... thanks.for any help

    Where else are you going to get them from if you're running a recap? Of course you pick up any hours you've used.

    When you recap, you get the hours that you have used from the last restart. I am not clear, but I think he is wanting to know whether he gets the hours of service for days before the restart, which is no.

    Consider everything before a restart a 0, unless you didn't meet the criteria for a restart then you might be working for my company and telling me how your peoplenet is broken.
