We had so many broker back/haul loads that were booked just to get truck back to where we were all/ready being paid to dead/head back to load at a preset time, the main office had a small statement in every broker load that we hauled that made clear the charges that would be billed if truck was not unloaded at time on papers they had our co. sign to get loaded, some brokers mark thru that part and return signed or a lot of phone calls and never signed, but after having to have to sit and not get unloaded for days and missing p/u times having to tell shipper that your truck was broke down and on and on that we started to understand why we weren't get the real good sounding good loads we were calling on from load boards and not hauling for some brokers?

I forgot, this actually happened twice before. I was fortunate that both of those times I was compensated reasonably for the amount of time that I held the load. Ironically those two times were both with the same broker which is a different Broker Than This Time.

We will see how this one works out.

Well even crazier this is an intrastate load so no bond will be involved.

But as far as the rest I am not threatening them in any way I'm working with the broker.

I suppose if they really wanted to claim that they could but that's really just trying to get out of paying it.

Most likely they are going to come back to me and say for whatever part of it we can't pay you this but will pay you this and I will have to negotiate.

Now I think your point is more valid if I were to say to them you're going to pay it or I'm going to put it in the storage or you're going to pay it or you'll never see your load again. That to me is duress.

That's not at all what I'm doing. I simply stated what the fees are for holding and redelivery and they are free to discuss that with me if they choose to.

I do think this is the best answer.

If it is on the weekend and the broker will not return your call whatsoever and you have other work to do and you can't receive new direction of what to do with the load at that point I don't see how you have any choice but to take it somewhere - in my case I wasn't far from my yard so I could bring it home - or put it into storage if you can find a place that will accept it.

But if the broker has contacted you and you try to work with him I don't know how you can just say I'm going to put it into storage unless they agree to that.

I did mention that to the broker not as a threat, but I asked him can we put it in the storage and I'll keep working and he said that that would be difficult because they have to get permission from the receiver to break the seal and it would complicate things.

Myself I think from a legal point of view and from a claims point of view it makes it much more difficult to do that if you actually have communication with the broker. I think at that point it's best to just try to work it out.

And the best answer of all in all of this is that I need to buy at least one more trailer. I have other situations with Freight that I could use at least two trailers, but at least when this happens I could just park the one and keep working and whatever I get I get and it's not as big of a deal.

Anybody know where I can find another trailer that isn't going to cost me a fortune?

    I prefer a Wabash duraplate...

Never meant that you were threatening them, just be careful on how you address it.

May be better that it's intrastate, depends on the laws in that state. May be able to go civil for it if you're not satisfied with their offer.

I hope I did not come off in any way except factual. Writing is hard sometimes to convey the correct emotion.

I know you've been around a long time and I know that you know what you are talking about.

I am just saying that I have tried to handle this in a way that is direct and end Fair with them.

I spoke with the broker this morning and they're working on it.

Hopefully it will all work out.

Ouch that sucks dino. Had something similar happen last fall. Getting loaded a p&g shippensburg that took around 12 hours. My 1st and last time loading there, I remember you said same thing happened to you there. Made me miss my apt and had to sit on the load for 5 days. The best i got was 300 a day storage fee. Better than nothing. Haven't pulled for that broker again

For anyone following this I'm going to start a new thread.

I don't know how to make a link to that thread but I'm going to call it - need help. What to do with this load?
