How does a PA Driver/vehicle inspection affect me?

    I was pulled over while driving a company vehicle by the Pennsylvania state police. The vehicle is a pickup truck and 30 foot trailer with graphics on the side. The officer stated that he stopped me for not having DOT information on the truck, he asked for my logs, health card and other things. I was not aware the vehicle was covered by DOT and needed to be registered, nor has my employer ever told or trained me on this. I don't even know what the log and health cards are. The officer gave me the report and allowed me to drive off.

    The report contained the following:
    • 395.8a - No drivers record or duty status. D-driver. Out of service. (citation number)
    • 385.301a - Failing to register with FMSCA. 1-power unit
    • 391.41a-f - no medical certificate. D-driver (citation number)
    • 392.2-slls4 - Speeding 15+ D-driver
    I do not have a CDL, just a standard license. I have no idea what any of this means. How do these things affect me and my standard drivers license? Who is liable, me or my employer?

    I seen a black army Blackhawk helicopter hovering over the interstate and dozens of all black unmarked police cars riding around and people dressed up like Darth Vader from star wars in Pennsylvania.

    Tom I would have that all checked out. I do not know what your truck weighed but there are certain requirements there that place you into a CMV or not. I believe you were not driving a CMV (commercial motor vehicle) and if you were none of those laws apply. You could also be under the 100 mile rule and if the company had all the records you win. At the least it sounds like you got a rookie cop that does not know the regulations.

    A company vehicle is a commercial vehicle by the use of it for company purposes.

    Two questions for the op

    1- are you from PA?

    2- what does the graphics say on the side of the trailer?

    Speeding 15 over? I'm also wondering what was on that 30 foot trailer. You should know a trailer that weighs over 10,000 pounds with or without cargo requires a class A CDL to pull it.

    Link should help you with the definition of a commercial vehicle in the state of PA.Especially look at this part


    (1) The definition of ‘‘commercial motor vehicle’’ in 49 CFR 390.5 (relating to definitions) is modified to read as follows:

    Commercial motor vehicle—Any motor vehicle or combination used on a highway in intrastate commerce to transport passengers or property when the vehicle meets one of the following conditions:

    (i) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 17,001 pounds or more, whichever is greater.

    I am from PA.

    The graphics are the company name and logo

    I have no idea what it weighs. The officer didn't weigh it. So how does he know it's a commercial vehicle if it wasn't weighed?

    Since only two of the violations have citation numbers, does that mean only these will carry a fine? Who is responsible for these fines? Speeding is one thing, but how can I be held accountable for my employers failure to register with DOT, even if it is required?

    No duty status is on you
    Registering with FMCSA probably on your employer
    No medical cert on you
    Speeding is on you.

    As the DOT likes to say ignorance is not an excuse.Even though you or your employer may not have known to register the DOT doesn't really care.
