How does your company address MWH

    You and my former logs/safety agree... I tried to argue that since I am unladen, and relieved of all duty to the load once I leave the plants property, that was the point I was PC, and traveling to my hotel, or restaurant. And a truck stop is a restaurant.

    Here is where it can make a difference, that 5 miles and 7 to 8 minutes drive time put you past the 1am cut off for a 34 hr reset. Generally that 1/4 of an hour will not make a bit of difference over a week.

    Being unladen and relieved of duty is only one element of PC as authorized by question 26 interpretations 395.8 FMCSR.

    The other element is that you have to be either:
    A) commuting between home and "normal work reporting location", ie terminal, or
    B) driving short distances from "enroute lodgings" for dinner, etc., ie truck stop, motel.

    Any other activity is outside the scope of question 26 which authorizes PC. The phrase "Off duty driving" is not found in the FMCSRs.

    what about those, that aren't empty. and have no reload. and bounce 100's of miles to go home????

    are they off duty, since they have no dispatch????? say, turkey weekend. 4 day weekend.

    I'd say no, last leg of your trip is home. Or your DH move is authorized by your company and doesn't not meet the criteria from being released from duty. That's just my opinion, others I know differ on that matter.

    I was a supervisor for Penske Logistics for 3 years. I cannot imagine successfully training a driver population on the nuances of personal conveyance. It would get widely abused, which is why my present company forbids it entirely. As Scalemaster can tell you a minority of the driver population has a grasp of the regulations. If a driver is penalized for driving when the machine tells him he shouldn't, the overwhelming response is going to be quite simple. Look for trucks to start parking in all sorts of places not allowed.
    Every driver on every trip is going to have to file a "flight plan", complete with alternative landing sites. Unfortuately those landing sites are going to be full or nonexistant. PC isnt going to make any difference.

    that might applly to company drivers. but o/o's run their own show. and the true o/o companies basically alow it. i know one company that encourages, when cicumstances allow.

    like i said, your empty. your basically off duty. you have no reload or anywhere else to go but home. but you can't be unladen. cuz your not going to bobtail back to fetch your trailer. it's going home with you.
