I was just curious to know if you have an accident like the Walmart guy do they only look back a couple of days/weeks or try to get you for a log violation a long time ago? So if your current logs are perfect but you screwed up a week ago can they get you for that?

Depends on how badly you screwed up. The driver that caused a school bus crash in MN several years ago was up on vehicular manslauter charges, but the prosecutors went after him for log book violations going back quite awhile. They got him on several counts, and put him away on consecutive sentences.
If they can show that the Walmart driver was at fault, I'd imagine he will do some time over this one. -
How long is quite a while? Months? Years?

I don't recall off of the top of my head, but I do think the log violations were across a couple of years. The driver rolled his truck on a turn at night, and ended up across a 2-lane highway. The bus ran into the truck, killing a number of kids. They went after the log violations since cumulatively they could get much more jail time out of that, than going after the criminal charges. Usually, log violations are just minor stuff... unless you motivate a prosecutor to go after you.

I believe from a companys responsibility to hold records of previous logs its a couple years, as far as the WM driver deal in NJ, he is on E-logs and obviously working for WM he has a good record otherwise he wouldnt be working for them, and before he worked for them he must have had a spectacular DAC,SMS,Back ground and what not...

Companies must retain records for 6 months, and I'd expect most to make anything older than that disappear in the event of an accident.

that's what i was thinking. how can they go back 2 years if 6 months is all that's kept.

An attorney can get a subpoena for as far back as he wants and qualcomm will comply.

I am basically asking if you have perfect logs recently but an error a year ago would they claim it as an accident or throw you in prison?
