How is this 1099 stuff legal?

    So if your W2 your basically saying that the government and your company can handle your money better than you can.
    These socialist liberals have no idea how wasteful a big organization like the government can be.
    They won't let you opt out of social security because they need your dollars to fund the people already retired. By the time your ready to have your money back it won't be there.

    That's about the whole of it. If you're running 1099s it's puts a whole lot more responsibility on you that's what scares most of them off.

    You mean like nobody speeds because the cops could give them a ticket? Some people & companies will do whatever they can get away with until they can't. Just wait until this country is populated by people from cultures where following the law is how you spot suckers .

    Department of Labor has nothing to do with us. We work under rules set up by Department of Transportation. I only have three trucks right now. I pay W2 wages. If you agree to work under 1099 then they pay you 1099.

    If you ever worked somewhere that provides health insurance, even if you pay SOME of the premiums, and then left and received a COBRA notice. You will see the actual cost of your insurance within 2%. Taxes & benefits are a huge cost to employers, not just your pay. I understand why companies would want to find a way to push thosr cost onto employees or others. As someone who had trouble with the IRS, I dont understand why someone thinks they can get away with cheating the system permanently. The penalties & interest you, or your company, will pay when the IRS shows up will make doing things within the rules look like a day at the beach by comparison.

    Since there is not always Workers Comp for those hired on 1099, you had better get yourself an occupational insurance. Many don't, so there is really a bad situation if they are injured at work.

    I have just passed my CDL A with all the endorsements. I am just beginning to weigh my options. I would guess that many of the recruiters that came to my school and spoke of 1099s vs W2 pay, well, they were not exactly honest about their pay/benefits/working conditions, etc...     This is a very good point ! Ohio BWC does allow for exceptions for sole-proprietors, but then again how does one 'opt-in' and what is the premium ? Can a sole-proprietor make an injury claim ? How does that work ? I know that Ohio is one of the last remaining states to have their own state administered insurance plan, it is compulsory, and it can be very expensive. The very fact the Ohio Bureau of Workers Compensation has over 29+ BILLION in assets tells me that they collect a lot more money than they pay out. Yes I said billion with a "B" and that ain't chicken feed.

    A lot of driver contractors get a personal private health insurance policy and think they're protected. But they're not ... not if they get hurt during the course of earning a wage. Then the personal whole health policy won't pay any benefits surrounding that claim.

    There seems to be a huge misunderstanding here. You're either 1099 or W2 by definition. You can't choose for yourself.
