how to file complaint to labor board

    I live in california.I had my truck and leased to a company in Texas last Oct.The company owes me money.I quit last Jan around second week due to slow pay.It would take a month to get paid for two weeks of work.They said i will be paid weekly,then every two weeks to every month.If you have any experience dealing with this kind of companies and filing complaint would love to get some info.Thanks and lets keep grinding

    I think you are out of luck from the avenue you think you want to take for a few reasons. The California Labor board will have little or no authority over a company in Texas. If you are a lease operator, you are governed by the terms of the lease, and probably not considered as an employee, so they would not help you. Probably the only avenue you could take would be thru the regular courts for not keeping the terms of your lease and payment, but the legal fees would probably outweigh what you are owed.

    As I read more and more of these types of stories from truckers (not to mention other industries as well), I can see that our once great nation is becoming a third world country. These are the types of experiences that one would expect to find in Mexico or Burma, or Haiti.

    Take them to small claims court.You go down to your court house fill out a form and there's a section that you briefly explained what happen.Cost about $30.00.Worked for me.Your company will get scared and they'll pay what's coming to you as the court date draws near.

    This was common place for many years before deregulation, where brokers would open up a business as an exempt commodity broker, but haul anything that would fit on the truck. Great pay for a few months, then hold back one week, then get paid after next load hauled, then checks took several days to clear, then the doors are closed and a bunch of trucks are 3-4 loads in the hole to them. Next week the same people open up in the same building under a different name, and immediately start leasing on more trucks and brokering freight. I know of a couple companies that had 10 or more names through the years, but same people running it.

    File a complaint with the Texas Workforce Commission.

    Bet you will receive what they owe you very quickly.
