How to get money for loads you hauled?

    Hi !I did 4 loads for one New Jersey Company ( they are not brokers), and ended up without payments for those loads. As for today they totally ignoring me. They don't pick up the phone and don't answer my e-mails. It's four months since invoices due date. I am thinking of filing a claim and getting money through court. If someone was in such a situation can you please give me advice how to start the process? Or maybe there are some other ways to get paid, that I don't know ? Appreciate any information !

    I have a friend who works for a law firm. Had her send them a letter on their letterhead telling them to pay up or we start the procedure to go to court, also threatening that they will be paying all court & lawyer fees!!

    I got paid the next week for my invoices plus late fees!!

    That's what I did, I wrote an e-mail to them, saying that I will file a claim. Here is what I got back from them "You state in your email below "you have no choice", and of coarse you are entitled to proceed however you choose, but it may be in both our best interests for you to hold off on a small claims suit " . ( claim would be for $4,000)

    Not getting paid is all the same whether a company driver or owner op,Call or leave an email one more time,give them so long to reply back and threaten with small claims court.

    I've been through this. It was pretty cheap but time consuming. The Judge issued a default judgement in my favor because the deadbeat didn't show up in court.

    Getting a ruling in your favor is one thing, collecting is another. If the deadbeat continues to stonewall, you can theoretically show up at their place of business with a court representative and start attaching assets (computers, office furniture, etc.), but it usually doesn't get that far.

    You can probably do a lot of this online, depends how NJ and the county is set up. You'll need the legal name of the company, physical address, paperwork that confirms that you had a contract/agreement that states the service you agreed to provide, and for what price, with the signature of a manager or officer. The court you file with should be the same county court where the business is located. It cost me about $150 to file, and have a third party process server hand deliver the summons, but that was in Cali. Your costs in NJ might be different.

    I agree with this post. Even if you do not know "Suzie" at the front desk, most of the time a letter from an attorney for $50 will get you a payment pretty quick. If that doesnt work, follow through either with an attorney (which I suggest) or go to small claims court. If you choose to use the attorney, the other party will have to pay the attorney fees anyway... just let the attorney do the work for you.

    I was based out of FL and had a small broker in Idaho giving me the run around. His office was across the street from a Loves which made it very easy. I grabbed a load out to ID, unloaded, and "stopped by" his office. I was polite, simply stated who I was, I said no more excuses, lost mail, etc, and left with a check.

    I was not so lucky. Stepped to the office two times and both times they said that accountant is out of office, when he will come back he will contact me. Since then just silence.

    I'm a bigger guy so maybe that helped. By your name, it appears you're female. Maybe some big Russian friends might help the visit next time.
