If you were not stopped and weighed on the road that you would have been overweight on, it will be the burdon of the State to prove that you were overweight traveling on that road. Unless they saw you come off that road or have some other reasonable explanation where you would not have been out of their view so that they know that you did not load more, I think that you should try the case. remember, it is the states burdon to prove you overwight when you were not scaled on that road. That should not be too difficult to beat. Speak with the prosecutor or distirct attorney and explain your case. Just don't let 'em catch you again, they won't make the same mistake twice if you beat 'em in court.

It could be a case that even though officers did not see him on that road and can not really "prove" that he was on that road, if that is the only way to get from there to where he was stopped then it would be reasonable to presume he took the illegal route and I would think the courts would go with that

What state are you in? I live in Indiana and go into IL. a lot and found its a lot easier to fight here in Indiana since IL does a lot of bridge laws and we don't here in Indiana.

Who does the overweight tickets belong to anyways? My husband brought an overweight ticket home Monday and I just fell to the floor, the cost is $9700.00 to me that is ridiculous do they really think truck drivers have that kind of money laying around? The address to the place he was going said one thing but it was actually the next road over and he came to a 90 degree turn with a bridge (no warnings prior to getting to it) and he had no where to turn arround and could not back up. Low and behold he crossed the bridge and just the other side of it sat a D.O.T and a county Sheriff (imagine that) I think it was intrapment but who knows. now we are facing having to be the ones to pay this outrageous ticket.
