NO he didnt blow the scale he wasnt even driving at the time. i would call and dispute it for sure...no way i would let that go on my record.

Been there, done that - once for a scale and once for blowing through a toll booth. AND I wasn't even in those states for either of them.
Here is what I did.
1 - I called the number on the letter and told them I wasn't in the state on the day.
2 - I told the person on the phone I have proof, my logs from that time, which is also on record with the company I work for.
3 - I asked who is the person or group I need to send that proof to.
4 - I called that person (group in the case of the toll booth) and told them what was going on, told them what proof I had and repeated to them the company has the same records.
5 - I faxed my logs from not just that day but the previous day and the following day to that person, called to confirm they got the info and again told them that the company has the same records on file.
6 - I asked for a determination to be sent by letter to ensure that the ticket was dismissed.
7 - waited two weeks (in the case of the toll booth, I waited six weeks) for a letter stating that it was dismissed. -

I got a Logbook violation in Utah once because I could not get the LEO to understand that I was running on CENTRAL TIME, because my company and home terminal is based in a Central Time Zone....he would not listen.....we were in the Mountain Time Zone; and as far as he was concerned, my logs and my freshly time stamped WalMart DC. bills were an hour off (he even put me out of service and followed me to the Flying J in Toole, Ut.).
I got home, and wrote a letter to the Courts in the district on the back of the ticket and explained it to them---a Judge immediately dismissed the ticket without me ever having to go back to Utah and face them in Court.
I 'probably' might have even had a law suit for my lost time being out-of-service...but I didn't push it; I just wanted my record cleaned up.
