What's your next move if they do NOT agree to the extra "delay pay". What legal recourse do they have for you withholding property? Do you just give them the storage info and tell them to figure it out? If they decide to sever the deal with you at that point do you still file against their bond for spent gas & mileage?
How common is it to not get a confirmed delivery date? On top of refusing deals without one, maybe you add a line that defines your "delay pay" scale...complete with offload & storage charges!

A company I worked for, Took all of his trailers from a place where they had announced that they were going to file bankruptcy, They were all loaded with paper, He held those loads hostage, and it worked.
-
It works. I've done it. I've never been paid COD or in advance though. I've only done it to get revised rate agreements from crooked brokers.
-
That's good advice. Getting a revised rate conf. before loading would be the best route.
I think the OP's scenario is a bit too melodramatic. Things can happen after you pick up, over which you or the broker have no control. I can't remember a single instance where a legit broker or shipper refused to make it right with a revised rate. If you accept a load under questionable terms from a fishy broker, well, that's your bad.LSAgentOZR Thanks this. -

This thread must have jinxed me. Customs broker screwed up and cost my driver 6 hours waiting. freight broker wouldn't take my calls. Finally, like magic when it finally cleared, the freight broker called me. I told freight broker I want and extra $375 for waiting + $400 for the layover. They offered $150. I declined.
-
wow, that's a long time dude, how the hell did it take 6 hours to fix the issue?
-
I was truck 2 of a 2 truck shipment. I had the attachment, the other truck had the whole machine. Then I asked the customs broker how the 1st truck was able to cross without any problems but I can't get across with only the attachment. Customs broker said "Oh we crossed that as a demo unit.......ohhhhhh, yeah I can do that." -
whoa whoa whoa, as someone who hasn't gone over the border yet, what is a demo unit supposed to be, where can i go to get some more information on this tomfoolery

So you had two brokers that had contracts and knew so little about this business that they just up and paid you before you delivered the freight. Absolutely amazing.
What you did was exactly what the title of the thread describes - Hijack - and you got paid not because the broker new you had the legal right to do what you are doing but because they decided it was cheaper and easier to pay-off the pirate rather than drag this out.
I have found in all aspects of my life it is better to be honest and ethical 100% of the time regardless of behavior of others. Justify illegal and unethical behavior based on actions of others may make you feel better but it doesn't change what you are doing.LSAgentOZR Thanks this.
