    Actually it is true (read the Reg) but that's not saying that all courts obey it or even honor it. Texas for instance is a state where local courts generally do not honor it as the Reg specifically says "states", and the locals believe they are not bound by it as they are not a state.

    The truth is that the Judge can do what ever he wants. Not supposed to be able to take a driver improvement class to avoid points from speeding if you have a CDL either,.. yet I know a guy who drives locally here for a concrete hauler and stood before the judge pleading mercy and thats exactly what the judge ordered him to do.

    So anything is possible in my opinion.

    The Judicial system is no different than any other system. Riddled with failures and personal agendas. And there lies the the problem with any organization, the people in the system.

    People get confused and think that the so called "Criminal Justice System," has anything at all to do with "justice." Very common misconception. It is a LEGAL system, nothing more, nothing less. Some folks know how to make it work for them, but most wind up having it used against them.
    (You get to be very cynical about the system when you work in it long enough...)o_O

    So true Mr.Don. Weather it's Milatary or what have you. It's 2 steps forward and slide 3 back. At a certain age at least for me I've had enough of it and just want out. You have wonder how long it will stumble along till it falls on its face.

    It actually does. I've done it several times since that reg went into effect. If you have a Hazmat endorsement, that makes it real hard.

    I'm not saying it is never done, I'm saying, and I disclosed the regulation which states that the states are prohibited from doing so or allowing it for the past 5 years. If someone can get it done I'm fine with it but just do not depend on it being so. or always being so especially in locations where one has had it done before. Eventually even in these jurisdictions they will enter the world of 21st century regulations or be dragged in to it.
