How to sue a broker for illegitimate claim?

    I usually put something like "Any claims must be noted on the BOL at the time of delivery in order to be valid." There is no reason why any damage or shortages cannot be noted at the time of delivery on the BOL. You don't wait days or weeks to file a legitimate claim.

    You can,t sue a big company..... do not waist any time. I have wasted hours and days and thousands, to get a legit claim for a load we hauled for Allen Lund in 10/2011. The bond TIA c/o David Carney is total waste of time, they told us pretty much, to F OFF. The amount is only approx $3000 but since the big companies get help from the behind the seen gangs and they all support the big guy they don't care. We went to NJ Courts and the court did not help us either. They dismissed the case saying some thing like they do not have any jurisdiction on them because they do not do any business in NJ. Now that was after providing solid proof with documentations there business is huge in NJ. I can't afford to go after them and they are enjoying extra $3000 cash from for just booking a load and acting unprofessional by not paying Fuel advance asking us to send the invoice to different address every time. Like I said earlier, that they went after the Christians n I did not do anything because I was not Christian. They went after the Jews n I did not do any thing and so on n on. Then they went after me and I ran for help, but there was no one left to help. There is big moral for the small trucker especially if you are not an expert in the court system you can't survive alone. There is huge amount of money in this business (consumer is paying for freight charges, Milk gallon was jumped from $2.50 to $5 because of freight charges being sky high and the milk price and all other prices are the same right??) but the gang behind the seen are watching your every move and they will not let you make any money. For example Landstar $1200 for 959 loaded miles to GA and then they all will stick together and offer you $1300 for back up the lane. IMO it is terrorism behind the seen. Independent truckers have to come up with some kind of union ( OOIDA is a joke as well)

    Just start calling on shippers direct. It eliminates the broker and you can factor the receivable, if you need the money.

    You are right about creating some sort of union. I've been thinking about this lately. If all the trucking companies would just swallow their pride and team up we could get every law against trucks thrown out. If every truck and if now every truck 90% of commercial trucks would shut down for two weeks the country would be on their knees begging for food and fuel and after they change the laws stay off one more week to send the message home. also rates would start to get a little better too

    Do you have a clear BOL? if so tell them that you intend to sue them for the money owed and time/expenses spent recovering your stolen money. notify them by certified mail. give them 14 days to get you paid. if you don't get paid then proceed with legal action. no you don't need a lawyer but you need to determine what jurisdiction you need to file in.
