    the cop is right ! If you just have one charge causing you all this trouble go to a lawyer who works regularly in the courthouse and ask him about expungement or getting your record sealed. It may not be cheap, but neither is being out of work !

    every co i looked at it was 3 years from last ticket ie: speeding reckless ect

    If you go to see an attorney find one that routinely handles criminal and traffic cases. They will be familiar with your local court and the employees there. Having the right attorney makes a big difference.

    I believe the FMCSA had some new rules about "ticket masking" a few years back. As I understand the rule a plea bargain before court is still permissable but getting a conviction "changed" after the fact would be masking and is now illegal.

    Did a little quick research and you are right. Here it is:

    384.226 Prohibition on masking convictions. The State must not mask, defer imposition
    of judgment, or allow an individual to enter into a diversion program
    that would prevent a CDL driver's conviction for any violation, in
    any type of motor vehicle, of a State or local traffic control law (except a parking
    violation) from appearing on the driver's record, whether the driver was
    convicted for an offense committed in the State where the driver is licensed
    or another State.

    Under this federal law you can not change the driving record after the conviction. I have seen judges allow defendants to withdraw a plea even years latter and then work out a deal. Or if a judge vacates, expunges, or gives you a pardon conviction it may go away. Do to this federal regulation you need to plea bargain first. However, most attorney's and judges probably don't know about this federal rule. If you were able to get a post conviction relief you still might get caught by a background check.

    In the state of Va, any speeding over 80mph is reckless driving. I was driving in a 70mph zone. I got a ticket for doing 81mph in a 70mph zone. I got a ticket and it had a fine amount on it. I paid the ticket cause mu unit was preparing to deploy that next week. After returning from Afghanistan (15 month ). Found out about the reckless charge on my MVR. After calling a lawyer, I was told its too late to do anything bout it. A person only has three moths to appeal the ticket.

    If you get the URGE to buy your own truck , check to see what you will pay for INSURANCE on it with that charge on your driving record.

    This is why it is imperative you hire an attorney to fight every moving violation/ticket you receive as a CDL holder. Its a big money game to the courts and all they want is money. The attorney would have cost around 350 bucks and the fine would have cost another 250.00 or so. The results would have been a reduction in the charges and you wouldn't have a "Reckless driving Conviction" against you now.

    $600.00 bucks to stay employable as a truck driver is pretty cheap especially when a truck driver can earn $1000.00 or more per week at a decent company.
