    Wrong answer, it would be illegal for any driver, tired or not, to drive with only having had a 9:55 min. break. That's just plane illegal, and I happen to follow the laws because it's my CDL and I am held responsible to do so.

    The regs are that I am required to do a post trip, and if I were running paper logs I would have to show 15 mins to do this. As doing what I'm supposed to do, then it should take me about 15 mins. I'm just required to do a post trip. Said post trip is to be as long as it needs to take. Mine takes 15 mins.

    The regs only require a post trip inspection report, however, your company can require a post trip inspection, to go along with the report.

    Thank you for backing me up. Everything you said is my main claim. I have to show a pre and a post although I didn't know that there was no time limit until all of this started. I was an OTR driver for some time and worked for FedEx ground and have always just showed a 15 min for each. I was always told by safety that I had to show both, and when I tried to just flag at FedEx once, I almost lost my job.

    As for my case, the managing partner for the company has already told OSHA that I was fired because I "complained about my 10 hour break", and that in it's self is protected by federal law, I guess they are just trying to figure out if I had a right to not drive my next shift. I would not have had the proper time off, but, I guess that we will see. And as to everyone saying "HE".... I am a female, not that it matters, I'm a good driver that is safe and accident free.

    I always do a pre and post, as their equipment is all slip seat and I'm never in the same truck. - Andrea (Cozy)

    Just the act of them firing me for what they are calling "complaining about my 10 hour break" is a federally protected complaint, and the managing partner has already stated to the OSHA inspector, that's the reason I lost my job! I at least have a case, and I hope I win.... No company should be able to do this to any driver.
