I Got Fired For Discussing My Hours Of Service

    It's crazy how there can be some many different interpretations of the laws and some DOT enforce some things and some don't. I just have always been told to stay safe, you would need to do a pre and post and show it as on duty. I guess I need to be more informed, but I thought I was following the laws. - Andrea (Cozy)

    Not at all. I had only worked there for 22 days. Every time she asked me to take any of the extra runs, I did, no questions asked. I did say that I didn't want to run out of one of the companies other yards, but other than that, no games ever. She just decided that she could fire me for talking about a protected right, but that she "knows the laws". - Andrea (Cozy)

    No paper logs, but what's ridiculous is that everyone is missing the point... Talking about your 10 hour breaks and any Hours of Service is a protected right, and you can't be fired for discussing this. Why don't you see what's really going on here? They have me on GPS with my times and if an audit happened, not only would it come back to them, it would also lead back to me. - Andrea (Cozy)

    Again, I had only worked there for 22 days, in those 22 days, I only had 3 days off as a local driver. I never complained about anything! I did tell someone in the office that I didn't want to run out another yard, but turning down work... not a chance. It wouldn't matter if she fired me for that or not, the simple act of firing me for anything about my 10 hour break was illegal. It's a protected act. I have one of the managing partners on email telling the OSHA inspector that I got fired for "complaining about my 10 hour break", protected act! - Andrea (Cozy)

    Was it really necessary to post all those times? You can reply to multiple posts in a single post and it cuts down on making a thread hundreds of pages long for no reason.

    I have always done a proper inspection. Maybe it's because I'm a female, but I'm pretty thorough when I do both. I just don't want to look as though because I'm a female, that I do a second rate job. I try to do the best job that I can do and that includes doing a post trip so that I can tell whoever I need to tell if I find a problem so that it's not left for the next guy. - Andrea (Cozy)

    Well that's not the case here. Just trying to follow the law. The simple act of them firing me for a protected right, is crazy. The best part is that I have an email where a managing partner (owner) saying that they fired me for "complaining about my 10 hour break".... that's illegal. - Andrea (Cozy)
