For anyone that is interested, After hiring my lawyer, I was told that they only wanted to be involved in pre-litigation and would not be interested in representing me for litigation because of the time that this case could take. I want this case to be heard, and finding the correct lawyer to take it to court has been a challenge, only because of funding. No matter what the OSHA investigator decides, after the decision, either party can appeal. With that being said, it might take a while to fight this, but that's what I want to do, unless OSHA sides with me and MTI doesn't appeal. I don't think it's fair that anyone should be treated this way for helping to protect their company and the motoring public by not breaking the laws. 10 hours is 10 hours! Not 9 and some change. It's our jobs as drivers to adhere to the laws.

With that being said, MTI has already contacted me and offered me a settlement... of pennies. Maybe they know I have a case. After all, one of the owners is an attorney. Either way, I don't have the funds to get the attorney that I would like to have, so I have set up a donation site. From all of the anger that I have received from this website, I don't really expect anyones help from here, but I thought I would post it.

I don't donate to any cases, unless i'm getting sued. Personally I'd just move on. But if you want to pursue it more power to you.

There are attorneys that take such cases on a contingency basis. No charge until settled.

This goes to show it is about the money.
Companies offer a settlement, as it is cheaper than YEARS of attorney fees.
And when an attorney says they want money to fight such a case, and won't take it on a contingency bases, they know they are going to loose.

All this over 5 minutes?! :biggrin_25513:

The Post Office wouldn't raise this big of a stink over just 5 minutes, you should have just sucked it up and did what you had to do. Geez.

If OSHA sides with you and the company appeals they would be appealing an OSHA ruling and then it would be between OSHA and them would it not?
