With all due respect, no thank you for your interpretations. The only thing being discussed here is pretrip and post trip. As to hazmat, I think I can satisfy that after hauling 1.1, 1.2, 1.3, etc and hypergolic rocket fuels for over 12 years. I think I may have some idea of what the regs state.
BTW, I have informed DOT inspectors that a post trip inspection is not required, then showed them the reg, in their own copy of the book. The response was, "well, what happens if you park the truck, for the night with a nail in a tire?" UH, find it the next morning, when you do your pretrip!!!
He has no case, as an employer needs no reason to fire an employee, nor are they required to give one.

All I can say to this,,,,,,, Please call me, I would love to represent you, taking candy from a baby and a quick 33% in my pocket. Thank yu MN, I can finally agree with you. That's why I never touch my truck. I don't even change a light bulb. Yeah I pay the man but that's the way it is. So while your looking around your veickle, it's on duty, Like you I walk around my veickle every time I stop, I flag on duty, and Inspection, There is no reg that says you have to do it, but I do. Dig deeper you will find more. Trust MN, I'm being a jerk for a reason right now..Sorry

I think you are writing the laws to your way of thinking. NOT what is actually written.
Show the regulation that states you MUST do a 15 minute pre-trip or post-trip inspection to support what you claim.
I have all weekend. I'm on a 34 hour re-set.
Autocar and I say the same thing. You bust my chops, but not his. Why? Because you don't want to tell someone else with 30+ years he's wrong? You don't know how many years I have experience.
Comply with the law and what it says you must do.
Review the DVIR and sign it if there are faults noted. Also is says to ensure safe operating condition of the vehicle. It doesn't say to do a pretrip.
So now you tell me you can complete a vehicle inspection in 15 minutes?
Did you crawl under and check the brake travel? If you didn't, you didn't ensure the vehicle is in safe operating condition. Do you know how many times I have seen brake cans HANGING Off a truck in a truck stop? 4 times this year alone. WTF?
Did you bother to crawl under the trailer to do the same?
Did you check your clutch for proper adjustment?
Now I WILL tell you there is NO WAY IN EARTH that you can properly and thoroughly inspect a vehicle in less than 45 minutes. Time yourself some time. No short cuts, no "I'll do that during operation." None of that. EVERYTHING. Including operating the brakes, inspecting brake travel, verifying that the parking brakes are correct. I spent 14 years in the military as a vehicle mechanic. I can't even begin to count the number of times we've had that discussion.
In short, you physically go down the complete checklist that the FMCSA puts in the regulations.
Service brakes including trailer brake connections;(ii) Parking brake;(iii) Steering mechanism;(iv) Lighting devices and reflectors;(v) Tires;(vi) Horn;(vii) Windshield wipers;(viii) Rear vision mirrors;(ix) Coupling devices;(x) Wheels and rims;(xi) Emergency equipment;
You sound the horn, you run the wiper blades, you couple and uncouple the fifth wheel EVERY inspection to look at the jaws. You verify that the mirrors WILL adjust every time, you pull out and set-up your triangles, you check the seal AND The gage AND you SHAKE The fire extinquisher, you physically touch your steering components, you measure steering wheel free-play.
Because if you tell me you do that EACH AND EVERY start and end of your day, you are lying.
And if you are logging that you are doing it in 15 minutes each and every day, you are lying on a sworn statement and writing a false logbook direct violation of 395.8.
A true brake system check takes almost 4 minutes in time just to check the system for leaks and air govenor set points.Last edited: Jan 12, 2013
