I know I'm an idiot but I have a DUI/DWAI question

    It's an insurance thing .
    My first and only dui was 20 years ago in my personal vehicle .
    Shortly after I got my licence back and had sat things out for a year after that I went back to work .
    Soon after that I got a letter from great west casualty saying they were overlooking my sin but would be on probation for a year and if I ever got another dui they would never insure me again .

    I would counsel caution when making statements about what constitutes reckless driving. Because I am not privy to all the laws in the lower 48 I can't say either way. I do know this. Unless state law specifically spells out a MPH over that constitutes a reckless charge, this charge is up to the officer! In almost every state I have some knowledge about reckless can be charged for most any amount over IF "there's that word again" there is other aspects to the case that would tend to support it. For example, driving 5 over in a school zone and striking a human! The officer might tack on a reckless charge too. This leads me to my next point. You can be charged with BOTH in a lot of situations. I know of a J.B. Hunt driver charged in his POV with speeding, rang the Georgia Super Speeder bell, Failure to maintain lane, and reckless driving on the Athens Georgia loop. Lost his job and if my memory serves spend a few days as a guest in the Clarke County Hilton!
