    Depending on the laws of the State you live in, you ‘may’ be able to file, using the credit from your previous employer before your 1099 job. Of course that would be dependent on certain conditions ie; were you terminated from that job, company closed, you quit, length of time between jobs, etc.

    Sure can. If you were driving their truck.... you were misclassified and should have been an employee. Happens all the time in a lot of types of work. File and see what happens, tell the State the details and they should investigate. Many times a worker will not only get the full wages they should have earned but also a penalty which effectively doubles the money they were not paid due to being misclassified. I speak from experience, happened to me several times. Would rather not work like that but sometimes one has to take what they can get to keep working. Attorneys will also take these misclassification cases on contingency.

    What you mean
    They offered me the OTR which they call it I think PTP “point to point” only terminal to terminal or their drop yard but read that it’s not that busy and basically LTL is where the money at with Ashley which not my case out of Vegas

    Also I’m not looking to get an unemployment
    Not planning to stay jobless for too long
    Beside I haters dealing with it since the pandemic

    Believe what you want but you are wrong about eligibility. Of course you want to work. But filing could get you some $$ even if you get a job tomorrow. And it likely gets the slimeballs you worked for audited. Then it won't happen to others. Too many get fired or walk away and do nothing and the employer continues to operate illegally.

    Two thoughts, first, why care where you land, you need work, so take what you can. You worked for what may be considered the bottom-of-the-barrel company and you have your standards set high because of what you heard?

    Second, I am assuming that 80% of your time was working in your state.

    IF SO FILE FOR UNEMPLOYMENT IN NEVADA.

    You qualify, and here is why.

    You worked for a scab company as a 1099 and were treated as an employee.

    Nevada does not look at your classification, and you can easily claim you were misclassified and they will go after the company for the cost of unemployment.

    I doubt that the "firing" (technically it is called a termination of a contract) had it spelled out in detail in the contract YOU signed and you have a copy of. And further, it isn't a case where they can direct you to do the work, they have to ask you if you want to do the work because as a 1099, you are entitled to refuse without retaliation.
