Why?
We are a regulated industry.
While it is clear and upheld in the courts (a little bit about that later), the Interstate Commerce Clause gives the power to Congress to create a law and/or regulation and the executive branch the power to enforce them - exclusively.
That clause is located in Article I, Section 8, Clause 3:
"The Congress shall have Power... To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes."
We have 2, TWO branches of government under the constitution, with a third to be limited in both scope and purpose. Congress and the president (by his signature) was given the power to regulate the courts but in 1803 the SC created stole power from the people by issuing Marbury and now we are so screwed up we have a court that is doing things that are not allowed by the constitution.
Look around dude.
It is not there to protect protesters who are protesting another country, or to act violently.
Outside of that, in any regulated industry, there is no protection when it comes to fulfilling a regulatory requirement.

And as you yourself wrote: "CONGRESS shall have the power"... NOT the President.
And the courts are in place to make sure every law, regulation, ordinance, policy, ect is in compliance with the constitution. Thats why the court cant tell a baker in Colorado that she has to make a cake for a gay wedding when it goes against her religion because it violates the constitution reversing a lower court ruling. Its all a question of rights. And when roughly 10% of the American public has no or limited knowledge of english it IS up to the courts to rule on if that violates the constitution or not, and they have every right to reverse it if they see fit to. So please, dont think for a minute that ANYTHING in this country cant be challenged in court. Especially when the government is the one that is trying to restrict people from doing something.Last edited: May 9, 2025
