If my employer doesn't pay me after I quit?

    Understand that you are not concerned about mis-classificaiton. But that can be used to threaten him along with a claim for unpaid wages. If you end up not getting paid and get an attorney the fees are paid by the company. You get your unpaid wages and most times damages on top.

    STEPS TO TAKE TO FILE AN UNPAID WAGES CLAIM IN FLORIDA
    Once you determine that your employer owes you unpaid wages, you need to take the following steps, if you want to make a claim under the Florida Minimum Wage Statute (F.S. § 448.110).
    1. Notify your employer in writing that you plan to bring a claim against them. In the notice, you must state that you are requesting unpaid wages, the dates and hours of the unpaid wages, and the total amount your employer owes you.
    2. Your employer then has 15 days from the time you submit the notice to pay your claim or settle the claim to your satisfaction.
    Unlike most states, Florida does not have a state agency that receives employee complaints and enforces state wage and hour laws. If you want to enforce your wage and hour rights, you may either file a complaint with the federal Department of Labor or file a lawsuit.
    The DOL likely won't help as they are most concerned with restaurant and construction workers. That is what a Regional Director told me this past summer.

    . Good man! I appreciate that. Shocked Florida doesn't have such an office. Saw a video (I thought it was Florida, IDK). and this official said we can usually get these resolved with one phone call.

    Thinking my guy doesn't like heat, doesn't like scrutiny. He may pay me. He may need a nudge. Regardless, this gives me hope and I'll continue to follow up.

    I said I don't care about the classification but if that's a way to bring a bit of heat. Probably all I'd need.

    But he is not an employee, he is a contractor, the claim will be rejected and the state will tell him it is a civil matter that has to do with the contract, not even a breech of contract unless there is a clause about when to be paid.

    Take a vacation for 3 weeks. After you get your checks, give notice, better yet, have already started with another company on your 3 week vacation.
