    Lets go over this a little more in detail... not bashing on you red.

    First the tires. I believe what you're seeing is the result of the tire fund ballance being brought over to the debit side of the settlement. As olphart said, when you have a tire expense, you'll see both a debit and a credit on the same statement for that amount - as if the tires cost you nothing. But you'll also see the tire fund debited for that amount. This is just closing the tire fund.

    From a quick look at your numbers up there, you might thing that you'd be about $2000-ish to the positive, but I can't see you spending only $1134 in fuel. If that were about per week, you'd be at $0. So lets look at it another way.

    Your gross was $6528, plus $700 in breakdown pay, or $7228 total. Over three weeks that's $2409 per week. I'm sorry man, but that kind of revenue is in break-even territory. I consider $3500 gross to be a real minimal week, and with really good fuel mileage I'll come out with something reasonable. If you hadn't spent so much time in the shop, or had some cash reserves to absorb some of the financial shock while your tractor issues were being solved, this story probably would have ended differently.     Forget leases, company driver or buy your own truck and run under your own authority and even those options have their pit falls.

    The idea is not to have anyone between you and the shipper handling your money because you will always have the middle man trying to beat you out of your money.

    Throwing the flag.....if you are guaranteed 1.02 and no matter what you make over that is taken by the company, Why on earth are they deducting this difference from your base and why in gods name did you sign a lease that would allow them to do this???????? this makes no sense what so ever. How can they charge you for tires a different leasee was charged for when you never signed nor asked for them? If you found something wrong with the truck before you leased it and wrote it down how can they charge you for that?? All of this is disjointed and totally unbelievable.

    So get a lawyer and go after them or better yet, save your money and take them to small claims court. If they can't show a receipt with your name on it then you are a winner.

    You can't fight a company like Prime with it's team of lawyers. The best thing to do is move on and don't waist any more time on them. No one has beat them yet.

    I have the invoices they sent with the last settelment sheet to prove it. I'm not going to spend the money to go to Springfield to sit in their owned and operated Arbitration court. And there was nothing in the lease saying they would take any money that I made over the guarenteed 1.02 per mile or I wouldn't have signed it. $1.02 will not operate a truck and pay their lease payments.

    The $1.02 per mile is a minimum guaranty averaged over every 100,000 miles. Prime pays percentage, fuel surcharge and accessorials. If your share works out to $1.50 per mile, that's what you get.

    There's been some, but you'd need a good case and attorney. Sounds like throwing good money after bad.

    They said the same thing about Swift. "you can't fight a company like Swift." but the did and the drivers won.

    This is what he said "You are guaranteed 1.02 a mile if the loads you haul pay more than 1.02 they keep the difference and deduct it from your 72% leaving you in a minus situation." Did I not understand what he was saying? I get what you mean, Shock, and that sounds right but he seems to be saying that they guarantee you $1.02 and if the load pays more they take everything over that amount and deduct the difference from you. Dosn't make any sense. And the lease..do you agree to waive your right to litigation and agree to binding arbitration to settle any dispute? I doubt I'd sign a lease that says that for $100 grand in equipment.
