    Seriously though, very curious to see what comes of this. That's insanity.

    In the 4 years they requested it was an average of 8 trucks per year 11 last year...

    What if the business dissolves or files for bankruptcy? Maybe that's the way to say ## and their 200Gs fine. It is not like no fuel tax was paid. I'd consult an attorney.

    Taxes are generally not excused by filing bankruptcy, especially with small companies where the owner is still personally liable for the debts and operations.

    The best solution is to engage an enrolled agent, which is a tax professional that has the training and authority to enter into negotiations on behalf of a taxpayer directly with tax authorities. Select one licensed to practice in the state the IFTA account was in and go from there.

    An enrolled agent generally will get the same, or even better results, than a tax attorney at a fraction of the price.

    Either way, they are going to have to recreate and file amended fuel tax reports to challenge the use of the standard averages and to show how much tax was already paid at the pump with fuel purchases. It isn't going to be easy, but dealing with taxes never is, although the alternative is better than having a tax lien that hangs over their head and prevents them from moving forward with anything new until satisfied.

    It was a little extra work but back in my cowhauling days we all basically did two sets of paperwork. One was accurate for IFTA because they only want to make sure they’re getting the tax money they’re supposed to get and they don’t care about hours of service. So those trip envelopes were always done 100% accurate as far as mileages and fuel were concerned. The other trip envelopes were done to appease the FMCSA in case of an audit. Trips and cash fuel purchases disappeared and everything looked sort of legal in their eyes. It wasn’t the easiest but the guy I was leased to went through a compliance review and an IFTA audit while I was there and we didn’t have any issues.
