Anywho, to the OP. The comments by others saying that they do not go in is not entirely accurate. It depends on when and where you are testing. I have not done a drug test since going OTR where the person administering the test was not on the other side of the curtain/divider. They don't stand there offering to hold things for you, but they were certainly in the bathroom with me (and everyone else that test at the location).

 

The following info can be found in Transport Topics 6/1/09, page 2. The report was written by Sean McNally and Eric Miller. Here are the highlights.

"An appeals court has upheld federal rules requiring "direct observation" of drug tests for transportation workers who either have failed or refused to take a test as a condition of employment.

The rule upheld by the court was designed to prevent cheating on drug tests by employees in the trucking, aviation, rail, maritime and pipeline industries who are required to take follow-up tests after successfully completing drug treatment programs. Prior to the rule, employers had the option of conducting return-to-duty and follow-up tests using direct observation.

The court concluded that the regulation complies with the Fourth Amendment."

If they try going in the bathroom with me, I'll pee on them. "Oh..sorry...got away from me."

 

Had 2 tests last week. no one watched.like they said, they watch you wash your hands, then close the door behind them until your done.

 

When you do your physical, they will have you pee in a cup so they can check the sugar level. They will put a stick down in it and watch to see what color shows up.
They won't actually do all of the hand washing, and all that other stuff just to check your sugar level.
But, for a D.O.T. drug screen, now you are talking about washing your hands, emptying your pockets, leaving all of your personal items outside the restroom. And, they will check the temperature of the specimen. It has to be within body temperature range.
In all of the times I've gone in to pee in the cup, nobody has ever gone in with me. But, they did say not to close the door. Just leave it cracked.

 

yea its not like a p.o. piss test no mirrow n there not watching most time yea get to go in all alone unless you look nervous then there gonna think your try to get away with it jus relax n youll be fine

 

It all depends on what kind of restroom is used for the DOT drug test. If it's a multi-stall restroom the collection site has two options. They can secure all the water and place a blue dye in the toilets or have the collection site ran as monitored collections. You can find all the information you want in the FMCSR Subpart D starting with §40.41.

 

I don't even want to know why your trying to go with your family in the bathroom with you. Anyways, ya you can get away with using your new whizinator for the company. Just don't run anybody over b/c those guys/gals will probably watch you a little closer.
