I am faced with this situation more often than ever. I was wondering what you guys think the actual law or the ruling would be should there be an accident. Let's say I am in the slow lane on the interstate and I cannot get over due to somebody being in the passing lane. Traffic is merging onto the interstate. Am I required to slow down so they can merge? Oftentimes, they do not even look out their window to see where I am. if I do not slow down and they side swipe my tractor, whose fault would that be? Would it be the four wheelers for not looking for me for not slowing down?

Most of the time I don't even slow down for the cars anymore.

Whoever is entering the interstate is required to yield. So if you are in the slow lane and they hit you upon trying to merge it would be their fault; however, that's not to say that an officer would not find a reason to cite you. Remember, any "accident" with a commercial vehicle brings the lawyers out of the woodwork. As a professional driver you should be anticipating the idiots who don't look when merging. This is basic non-commercial driving information. I suggest you re-read your beginner's driver's manual.

I assume that it was the people merging onto the highway that had to heal. I always thought slowing down with a courtesy and not an obligation. I just wanted to make sure in case something happened. I slow down for trucks because I know they take a while to speed up. But I do not feel like I should have to slow my truck down for a car. They can adjust speed a lot quicker than we can

Merging (or more so, the fact that most people don't know how to merge) has been a pain in my butt forever. Fuzzy is correct...the vehicle merging into traffic is responsible to make adjustments to do it safely and/or yield. But that don't happen these days. This self-centered society we now live in is "every man for themselves"...so watch your back any way you have to---don't let them hit you.

You "should do all that you can" to avoid accidents. Now, if you can't, in that situation, it'll be their problem.
Happens all the time. Let them in and don't get excited. Better to let it go and get to your destination 1 second later than have a "DOT reportable accident"fuzzeymateo and Pmracing Thank this. -
You're right, it is a "courtesy" . But you shouldn't have the attitude "in case something happened." Instead, remove yourself from the situation as much as possible, watch how traffic is behaving a mile or so down the road, anticipate the idiot's actions, and remember; most people on the road are either on dope, looking for dope, selling dope or they are a dope. I don't trust anyone in a moving vehicle. That includes commercial traffic as well since "experienced commercial driver" is becoming a thing of the past with the high industry turnover.

good information to know. Thanks guys. I do try to slow down if there is only one or two cars on the ramp. I get a little nervous when there is a whole train of cars coming down the ramp. That is kind of what my question was about.

More times then not its always the trk drivers fault.Thats just how is it.Companies will find ways to make it out to be the trk drivers fault.What you need to start doing is keep eyes moving at all times and look far ahead.Soon as you see the lites on the police car,turn your blinker on and get over when its safe to do so.Alot of times cars will slow down and let the driver over because they see the accident too.If by chance you can't get over,go slow while passing the accident.I normally put my flashers on till I pass the accident,especially if there is a lot of traffic.When you're trying to get over and you see a vehicle in the passing lane flashing his headlites,hes telling you to go ahead and get over.
