i finished my rehabbing, and got a doctors clearance to go back to work.
in another situation i have been thru, we have here in my state as i said TDI. i went onto that, sued the other party, (the guy ran a stop sign) so no need to sue my employer. (i was in a company vehicle)

starting a paper trail is paramount either on workman's comp, or state TDI insurance. he needs to check and see if his state has that insurance. if so, there is a possibility his lawyer can get him off comp, and go onto TDI, THEN have rights to sue the other party. there are time limits,. i think here, i'd have 2 years before that expires.

This is my dilemma as well,guy pulled out from a stop sign into my lane....I was in a company truck. Not my fault and don't want to sue my company(not their fault) I'd like to go after the other company but not sure if it's possible. Lawyer is looking into loopholes(as they all do) never sued anyone before or do I really want to. I'm the only provider in a family of 5 so it is a problem either way. -

Yeah my company hasn't done anything wrong in this case with me so I definitely don't want to sue them(would never just sue just for the sake of doing it). I do hold the other company responsible for this situation hence my reason for wanting to hold them accountable. Thank you though, it has been helpful! -
Two years ago I was involved in a simular situation. I was able to sue the other driver. But I had to pay workers comp back for the medical bills out of my part of the settlement. My lawyer said it was because you are not allowed to profit off an injury or something like that.

That makes sense there,curious if he factored the costs you would be paying back into the settlement .
