Can anyone tell me for sure if I do or do not need to get a NY HUT permit? I have NY listed on my IFTA and apportioned registration. Once everything goes through will NY pick it up and bill me? Any one know what I need to do? Being from Connecticut most of the rest of the country is only available going through NY.
I am almost there and none too soon! This has been an adventure to say the least. Ive got a life-time supply of red tape if anyone needs it.

Just check the web site and it says "Interstate carriers may not be required to renew their TxDOT Certificates due to the Unified Carrier Registration Act of 2005." www.dot.state.tx.us/apps/mccs2/ So basically UCR may have removed the requirement. It only cost $10 to do the credentialling.

Watch out for the business property taxes! You must do a rendition of your trucks/trailers. Harris County got me this last year at 100% value because they did not allow me to allocate for TX only miles. Still trying to fight that one. -

Check with the county where you have your truck/trailer or any revenue-generating property/equipment. They have a form you have to submit (rendition) that places a market value on this equipment, then it is taxed at the same rate as your current county/school taxes. For OTR operations, you can allocate your miles so that your taxes are only assessed on the miles you run in TX. For me, that equated to about 35%. For 2007, my Harris County taxes (not school taxes) is $1900 # 100% value because they failed to tell me about the allocation, so it should be closer to $650. But I had 4 trucks running. The school tax portion is way, way worse than that....closer to $5K. Just google county rendition for your county.
For the first 5 years we were here, never knew a thing about it, then one day get a tax bill. Supposedly when you apply for your apportion plates that should be the trigger for the rendition, but as with most things in government, it doesn't work. Technically they can go back and hit me for the previous years, but I doubt they will. And I'm ticked at my CPA for not informing us that this needed to be done.
Bottom line, for a single truck/trailer running OTR in your county shouldn't be very much at all. Just be prepared; way better than being surprised. -
my property taxes last year were like $160, with school taxes,on 13 acres so I can't imagine it can be too bad but it's somethign to look into. WI didn't tax businesses like that. sounds more like GA's BS advolorum tax. I moved out of that state in big part due to that tax which I see as total double taxation

My beef has been that KS, AR, KY all tax on the same property, so why should I have to pay the same taxes again. Problem is, the appraisal districts have mostly ignorant flunkies working there who haven't a clue about the TX Constitution, Texas Property Tax Code or the trucking industry.

i'm learning that TX truely is like it's own country. unfortunatly when you deal with a national business you still have to deal with the "other" country too

Do those states require a special permit to run in/through them, to tax your real property?
I have been researching NY HUT, but that is a pounds/mile highway use tax.

Services can get an "Emergency NYHUT Permit" in one or two days but they range from $60-$100.
New York State Tax suggested ComData, Custom Permit Service and another but I didnt have the time to write it down, it was a recorded message.

My next question is ......
Technically as an OTR Trucker are you suppose to pay income tax in every state you drive? -
My statement had a small error in it; KY does not tax on property value.
KS Ad Valorem taxes are paid if you roll one tire across the state line. Doesn't matter how many miles you ran, just the fact you entered the state. http://www.ksrevenue.org/pvdmc-faqs.htm
AR also charges an ad valorem tax http://www.apscservices.info/taxmc.asp and is calculated on assessed value.
KY charges a separate mileage tax each quarter based on the miles you run in the state. www.transportation.ky.gov/dmc
NM charges a separate mileage tax each quarter based on the miles you run in the state. You can get an annual permit ($10 I think) so you don't have to buy your way across each trip, then file the tax each quarter. Rate is $.04378 per mile. What I don't like about NM is they participate in IFTA and charge the extra miles. And if you run the lower east/west route, you kind of have to play their game.
OR is another state that does the weight/distance thing, but you have to buy your way across, unless you run it frequently then I think you can get a permit of some kind. But you still have to file/pay each quarter based on miles traveled. OR does not participate in IFTA, by the way.
As far as NY goes, haven't a clue. Don't apportion to go there and based on what you have shared, don't plan on it ever.
