Not illegal pursay but in the trucking world it is if they find out and any company that uses dac services will find out.which is about every medium to large size carrier.

Before I got back into trucking (10 years ago), I was at a Veterans program where they drug tested and breathalizer tested everyone. It was a Dormacilly living arrangement with weekend passes. I never took a pass in 2 or 3 months.
One of my piss test came back positive for ethanol (alcohol). The Director and all the staff knew the test was a fluke. They and everyone involved know those tests have high error rates that give false positives.

im in south Carolina and its not prohibited, but over a phone call a past employer can only say the time you worked there and your job title. Anything else they have to mail them a request in writing and be responded to in writing. which most places wont bother to do I guess some would but it didn't effect me.

If you are going to be on a public forum asking about lying to employers, breaking the law, and doing drugs, you should probibly not have your picture as your avitar, or use any identified information. A lot of companies do extensive Internet searches to find people on social media and find out about you.

+1 Lying about it means you'll be looking over your shoulder every time your phone rings.

"Return to work" process is off you've been fired or put on leave of absence because of a positive test. Where I live, the process involves going to rehab, attending therapy sessions with an addictions councillor, some version of a 12 step program (Jesus is optional here), having a psychiatrist sign off on your progress and 6 fully supervised random urine samples in your first 12 months back to work.

If it wasn't a "safety sebsitive" position you were fired from here, none of this applies. Your state's labor board should be able to shine some light on these questions.

Lying on an application is grounds for immediate termination at EVERY trucking company I've worked for and hear about.

US express scheduled an orientation date for my on the 28th. Does this mean my DAC is clear of the positive test? They wouldn't hire me otherwise right?
