So I have an axle that burned up some bearings and I took the hub off and tires ect, chained it up, no load on the trailer, the trailer is a trip axle. Is it legal to drive it home like that?

Absolutely. As long as you meet the weight limits on the remaining axles and the bad axle is properly secured, you're good to go!

Put the tires on the top or in the trailer and inflate the air bags on the axle that has the tires still on them, so the other axle can't drag the road?

You need to block off air to brakes and bags on lifted axle . PS make sure air leveling valve is on a lowered axle.. I pulled one home that way but mechanic placed leveling valve in a fixed position which meant over time air bags would drop . I had to stop every few hours to move valve to refill air bags..
