Is it Legal to Operate a CMV on Private Property without a CDL , Here's the Scenario

    I have a question Y'all

    A Manufacturing Facility has a Yard Dog that moves trailers around with an old tractor but sometimes when he is not available another guy from the warehouse who has been taught onsite does it. A few safety issues have been raised as he does not have a CMV and was sort of self taught. Anyone know where I can find rules or regulations about this? We want to create a safety program to teach everyone who may have to operate the tractor at some point to do it the right way and in compliance.

    There is no government requirement for any license at all, let alone a CDL on private property.

    The company’s insurance underwriter might have some requirement but that would be about it.

    Requirements for a company safety program for moving trailers around their own lot is entirely up to the company, the company can have any rules for this that they want.

    This actually happens quite a bit at places like that and Warehouses.

    Unless it goes on the road, no CDL needed. Hell if it stays on site and doesn't leave, as far as I know, you don't even have to put a plate on it.

    Give it time, in 2011 the Dept of Labor tried to have kids banned from even driving tractors until older than 16 on family farm...Heck, by 13, you better be able to move the horse and cattle trailers wherever you're told to unassisted...

    I'll leave it at that so thread doesn't get moved to politics...

    It's legal, just not always wise. This is the yard dog that the unlicensed loading crew uses to spot trailers where I work. They're not allowed to use our road trucks. For obvious reasons.

    I don't know why this is even a question. Of course it's legal, if it's never touching a road owned by a goverment then it's perfectly fine. A local place has an unlicensed driver that drives between plants in town with a yard dog with no plates done that job for 30 years and he's never been bothered.

    Legal I suppose was the wrong word choice , "Wise" as mentioned above is perhaps what I was getting at due to potential workers comp or OSHA concerns. This is not a farm yard area where we are working with people who have previous experience with machinery like this so potential for accidents and finger pointing is a concern.

    Well that's what's wrong with people, to worried about getting the finger pointed at them and to eager to point the finger. It would be a whole lot easier if we didn't have to deal with this all the time.

    Well when you have people who do not follow directions and then get hurt because they do something they were told not to do it becomes a hazard to many others. Unfortunately some people have no common sense no matter how well you cover safety training with them.
