Is my company trying to swindle me?

    I do not have a copy of that agreement which is why I do not believe it exist. I suppose I understand the business side of it all, but he isn't a very professional owner at all. Just recently I found out this guy is like in his early 30's and already had a failed company.

    I just was young, dumb and fresh out of school.

    Im 23, fresh out of school and not too familiar with how taxes work. I guess this is a learning experience. In other words, I should have listened to my lady.

    Triple Six, I was on the 40W in AZ and hit an ELK around 1am. Is that really my fault? I was off for a month because they just wouldn't get me another load but thats my fault too right?

    Between Flagstaff and Williams, I'd wager. As long as you didnt cut your wheels and you did nail that elk, then everythings a go. But you sat at home for a month waiting for a load? 30 days? With their truck just sitting there?

    So you did not choose to take a month off sitting at home. They did not give you a load for a month?

    I didn't want to be a sub contractor, I was looking for another gig from the minute I started here. I guess now I have to find out the policy and everything I agreed to and then sue sue sue!

    I made a mistake by working for them. I don't play fast and loose with the IRS, that is an assumption you are making about those who file 1099. I file as Incorporated and pay my taxes quarterly. I save all my receipts while on the road. I didn't know much about 1099 and trucking companies, but I do know how to pay taxes.

    I'd like to thank everyone for the replies. If anyone has any idea about whether or not trucking companies can 1099 the employees please share.

    They left me at home, ignoring most of my calls and sending some other poor student out OTR without a trainer. This company has maybe 9 trucks and 3 accidents in the last year.

    I should add that they have left me in multiple locations for day(s) while waiting for a load and even fuel. I just sat in Seattle for 3 1/2 days waiting for a load with no layover pay and threats of being fired if I deadhead home.
