Welcome to trucking. I feel for you however, since it's an at will state they don't have to have a reason to terminate you just like you don't have to have a reason to tell them shove it. As far as someone that you can call , no, there isn't. The only way that you could call someone, say the labor board or osha is if they terminated you for refusing to break a local, state, or federal law. And even then it's gonna be like pulling wisdom teeth to get anything through. If you pick up the jan 14 issue of "the trucker" at a truck stop there is an article in there about a driver suing his former employer for unlawful termination. Don't know if that will help you but it might. As far as this other employee, you can file a libel suit against him/her. You obviously have endured damages due to his/her lying. Depending on how much your looking to hit them for you might want to ask an attorney, and if that isn't good to go you can always file in small claims court which I think is a $5000 max. I'm not an attorney nor am I trying to infer that I am. But 22 years of dealing with idiots out here trucking I've learned a couple things. Hope this helps you and good luck. Besides, the real loser in this instance is the company cause they lost a professional loyal driver, that they obviously didn't deserve in the first place.

I spoke with my Saftey mgr today. He basically said to continue dealing with this the same way I have been. I've been pretty level headed. I've tried to keep my cool. But, I'm extremely bothered by the fact that one person who has a problem with me could essentially end my career with a company I've been very loyal to. On top of that, the area where our terminals and loading racks are located is much like a high school. Drivers from every company talking about every other driver, and each other. So this news spread quickly. I am known as a dependable driver and very professional. Now everyone is questioning me and my credibility as a good driver. If it's spreading through the racks, you can believe other companies have heard it as well. That's not right.KW Cajun Thanks this.

Someone asked why would a driver do something like this. In the gasoline business there's a lot of times you're all together and drivers talk like an old sewing lady just to stir the pot. I've seen it done and it's a shame but I guarantee every gas hauler will agree.

I know there will always be back stabbing and brown nosing but when you have seniority it gets even worse.mje Thanks this.

Still having product after delivery isn't that uncommon...overestimating what will be available to transfer into the tank can happen. The issue I caught was the location you chose to "check" your compartments. Your explanation sounds like you pulled off along the roadside, not in a secure location, and without any verification that you weren't trying to "sell off" product and put the $$$ in your pocket.
The "possibility" of theft was there, and a potential for an unsafe fuel spill (no containment field/location) was also there.
I don't think you would do very well with any lawsuit...just get your stuff together and move on! -
Not so much worse...it just gets "old-er"!!

Well as was said, in most states an employer does not a reason to fire an employee, not right but thats how it is. If there was any sort of fuel spill no matter if leak or pulled handle safety should have been first to know asap. to be terminated for it should have been investigated to determine what happened . when dealing with anything falling under haz-mat regs it can be touchy and i'd make sure you have all your ducks in a row and then talk to a good atty about it, but wrongful termination is a hard sell now days. good luck

Back stabbing and brown nosing are ABSOLUTELY and POSITIVELY 2 DISGUSTING traits that any human being in the world can have.
I SHAMEFULLY have been GUILTY of it myself. I have NO EXCUSE for it whatsoever.
Years ago, when I was a young recruit in the U.S. Navy, a 1st. class petty officer, who did retire out of the U.S. Navy with 23 years of active duty service, had said to a group of us juniors that there are only 3 people in the world that you can trust with a secret: ME, MYSELF & I.
Looking back on that, that 1st. class petty officer knew exactly what he was talking about, God bless him.
God bless every American and their families! God bless the U.S.A.!Last edited: Jan 26, 2014
