Is it acceptable to hold a new drivers first paycheck? As in he does one trip, doesnt get paid.. Does another trip than starts to get paid..receives the 1st trip paycheck later on..
Is this acceptable..?

How would you like it if you did some job for someone and they didn't pay you? That is what you are asking...if it is "legal" to withhold someones earned pay. No it is not! -

So basically, what he does this week he gets paid for next week? If so, that is perfectly legal and actually quite normal.

I suppose it would be determined by what you agreed to. Excepting maybe some time to process paperwork, I think most either settle on a specific day of the week or some number of days after POD is submitted.
"Holding a paycheck" is W2 employee language. For example, I don't actually "hold" someones pay deliberately. Pay week ends on Sunday and driver is paid for loads before that and on the truck on that day. I have till Tuesday (2 days) to turn in payroll numbers to the bank and they cut direct deposits on Friday.
I'd say on a 1099 someone keeping one load in arrears (practically a deposit or escrow in that context) is a little sketchy unless there's more to the story.otherhalftw Thanks this.
