Or you can sue them - when they don't show you get a judgement against JBS. Then... collect on the judgement. If they continue to ignore you, you get a judge to liquidate their assets. Its happened in the past - you just can't ignore a judge.

Good point. If it's on your property, you'd be amazed how much power you have over that equipment.

I'd make sure you are officially employed elsewhere and have resigned from JBS (after repeated attempts to get them to move it) first.

Sleep apnea affects not only adults but some children as well [4]. As stated by El-Ad, "patients complain about excessive daytime sleepiness (EDS) and impaired alertness." [5] In other words, common effects of sleep apnea include daytime fatigue, a slower reaction time, and vision problems [6]. Moreover, patients are examined using "standard test batteries" in order to further identify parts of the brain that are affected by sleep apnea [7]. Tests have shown that certain parts of the brain cause different effects. The "executive functioning" part of the brain affects the way the patient plans and initiates tasks [8]. Second, the part of the brain that deals with attention causes difficulty in paying attention, working effectively and processing information when in a waking state [9]. Thirdly, the part of the brain that uses memory and learning is also affected [10]. Due to the disruption in daytime cognitive state, behavioral effects are also present [11]. This includes moodiness, belligerence, as well as a decrease in attentiveness and drive [12]. These effects become very difficult to deal with, thus the development of depression may transpire [13]. Finally, because there are many factors that could lead to some of the effects previously listed, some patients are not aware that they suffer from sleep apnea and are either misdiagnosed, or just ignore the symptoms altogether [14].

well thank you doctor....:biggrin_25510: i have been driving for 13 years and i have never ever had a accident or ever ever have fallen asleep while driving..this sleep apnea is a multi million dollar a year industry..i find it all just a huge ### scam...i have had this retarded sleep test and supposedly tested positive for sleep apnea...and now because of these crazy ### doctors.. now all of a sudden im considered 300% more likely to have a accident versus someone with out sleep apnea...i find this absurd...i have 13 years of experience in driving..and now my safety record is thrown out the dam window thanks to this bull@hit scam called sleep apnea, what the next big scam? cant be blonde hair or blue eyed or i know maybe over a certain age...once again all just a scam.. and thanks to this sleep apnea bull@hit scam i have had to goto the state to apply for temp help... so yea thanks to "sleep apnea" and some bull@hit jbs carriers policy..so they can get a cheaper insurance policy...just like the eobr's is not about safety its all about saving a buck so they can pocket more and screw the driver even more...:biggrin_25516:

Tankerman - I'm sorry for you that you've lost your job, that really sucks.

I'm not really sure what to think about it all though. They gave you 6 months to get the study done. They don't automatically fire you if you do have sleep apnea, they just want you to get treated for it. I have to ask, why didn't you get it treated? I know it's an inconvenience, I know that you may have to lose a few weeks of income, but get treated for it. Whether you're driving a truck or not, it may save your life!

Clearly there is a trend in the industry overall to hiring and retaining safer, healthier, more responsible drivers. I'm pretty sure its not a conspiracy against you personally Tankerman . . .

Funny how the newbies come out post what they read. The way I see it any driver coming off the road and sound that test the same night will mos likely test positive for sleep apnea. They should at less give you one night to get your clock right from driving and sleeping in 10 hour periods. Now that is just what I think should happen. I am not one of the cheerleaders as I call them backing up everything JBS does. If JBS did something right I would but they don't. Now there are somethings they do right not saying they don't. But either way they can do something to better take care of a driver that is going through the test. Now I don't know about you shrugof but a few weeks no pay can do some major damage to a driver who needs every dime he works for. If I didn't get paid for a few weeks it would put me months behind on bills that would take me months to get caught back up on. Now weather you are a newbie or a office jockey I don't care. I already know that the ones in the office do what they can to justify there job and don't care who they step on in doing so. The drivers of the company is what keeps this company alive. One day they will realize that. As for me I move on somewhere else. You newbies can have it. Besides that what JBS wants more. Newbies who don't know what there are doing or what you should be getting from the office.

Take care tankerman I hope things get better. You to 26.945 I know your reading this....lol. Hit you on the skip later.

Exactly Shrugs! There is a lot of blame to go around but in the end you can only blame yourself. You knew you had to take a sleep study and between that time you could have applied for other jobs. If you tell your next employer you left because of medical reasons. They are probably unlikely to hire you.

From what I read it's not all about falling asleep but having a late reaction time, and companies or the motoring public can not have people driving 80,000 pound vehicles with slow reaction times. It's very dangerous and can cause your life or the life of someone else.

I'm not sure what my bmi or neck size is, but I have 2 months b4 I take my medical examine. So I'll start doing what I can to fly under the radar such as eatingi alot better. no more supper sizes, and exercise routine.

I can't blame mc donalds for making me buy the delicious angus burger and supersizing my fries and large frape. I got to say no. Because not only my career can be in jeopardy, but how much time my kids will have there father on this earth. Safety first. Have a good day.

I will have to break my silence on this sleep apnea bullshat. I took the test, lost 2days work at ave 150$ a day,and the test cost me 343$ out of my pocket.so 643$ cost to me for a COMPANY REQUIREMENT! I have the symp.that the libtard listed above...yet I was not diagnosed with sleep apnea. My irratability etc etc comes from jackazzed driver in both cars an trucks, azzhole receivers and shippers truck drivers with their head up there ###. My drowsiness on occation comes from boredom of having driven the same roads over an over all over the country, and a slooooooow ugly truck doesn't help either, espescially when most all I have driven has been extended hood petes an a couple of W900Ls. So their basis for the test is BAKER SIERRA!!! AND discrimitory. All truck drivers should have to take the test or none.I'm sure jbs is gettin a kickback of some kind from the government, since the only money gov.has is the money taken from the people at the point of the IRS GUN,I believe I have paid my share regardless! Over 12K in taxes last year and only 850$ back. All this BS is gov driven, you can put a frog in boiling water an they jump right out,put em in water an slowly turn up the heat and they will boil to death-this is what is happening in all aspects of industry,a slow an gradual turn to a socialistic an communist country. Sorry for the rant-im just sick and tired of ALL the BULLSHAT!!!!!!
