    That's a change that isn't in the "Green Book." I hadn't heard that the MRB had moved sleep apnea recommendations out to a rule making yet...

    Ok doc its in the book. But why is only some companies test and others don't? And once again I will state if it is truely in the eyes of safety then all cdl holders should be tested. As it was told there is no way of knowing who has sleep apnea and who don't. Skinny/healthy people can have sleep apnea as well as fat people. But the government chose a 17" neck, or a bmi of 35 or more. I find that discrimination. Since they say its all about safety. And drs say those guidelines don't work and don't prove anything.

    A person is physically qualified to drive a commercial motor vehicle if that person:
    Has no established medical history or clinical diagnosis of a respiratory dysfunction likely to interfere with the ability to control and drive a commercial motor vehicle safely.

    What I would like to know is how does a doctor have the skills or know how to determine if i can safely drive a cmv? I have been driving for 13 years. 6-7 of those years was pulling a tanker where the freight is constantly moving. But yet never had a accident. So with my experience and my mvr. That should qualify on its own. Rather you drivers want to face it or not. The government is going to find one way or another to put you out of work.

    Just a heads up. Better tell your husband to watch his weight. According to what you said. @ 6'3" and 250 pounds his bmi is 31.2, anything 35 or higher will have to get this retarded sleep test done.

    At this point its mostly up to the insurance companies and the safety departments. Even with that "rule" on the website, the last I heard was that it was still a recommendation that hadn't been put into a formal rule by the FMCSA.

    Its not 17" neck OR 35 BMI . . . its 17" neck AND 35 BMI. Not everyone has eLogs either . . . right now, that day is coming soon though. Again, there are some things you can fight, some you can't. Being with JBS for only 6 mos probably doesn't give you much voice or leverage.

    The question is this . . . has JBS been dishonest with you? If so, THAT's what I'm interested in knowing about. Otherwise, accept accountability for yourself.

    well i knew i had to do a dot physical and the oh so wonderful ergo test, which i passed....i was actually issued a 2 year medical card..but then the wanna be doctor measured my neck and it was 17.5", so there goes the 2 year medical card and here comes the 6 month medical card... the part that i feel jbs was dishonest was the bmi/ neck thing for a sleep study.... if that was mentioned prior to getting on the dam plane. i would of never went.and then never been put in this situation...at this point this is neither here or there..as it is what it is...oh by the way i got a phone call from the sleep place..gotta call back and make another appointment to go to myrtle beach and pick up my brand new retarded sleep machine.then i get to bring it home and sleep with it for 2 weeks then bring the machine back to the sleep place have them download the info, and then the doctor will look over the info and also send the results to safety in colorado..if there supposed quack wanna be doctor says im ok, then the safety dept will schedule me for a dot physical..so yea from the way its looking i will be out till the end of feb 2012..

    Now, now.... quit lieing to these people!!!! I've met him myself and he's really 3 ft 6. :biggrin_25523:

    I also like 3 sisters. Diners not bad, can buy beer at the corner store if your going to be there awhile, and that hamburger place across the street, is pretty durn tasty...... pricey, but tasty.
