    Sue him for what?

    He says he didn't quit but he signed a voluntary quit document saying that he did quit so what do you think a court will believe?.

    That and the fact that there are no real damages to collect (other then maybe pay for his last load) means no lawyer will waste there time on this. At best he has a small claims court case where lawyers are not allowed.

    Like others have said, best to just learn from it and move on.

    I worked for a small family owned company and ran paper logs.. we ran around scalehouses cause none of our equipment ever would of passed... ran hard.. during the week... would get a load and drive 14 to 16 hours just to get it there on time... then grab only a few hours sleep to roll again...

    It all caught up to me.. I was so tired and fatigued.. days just blurred into eachother.. I was tired and stressed I couldnt even eat.. lost 30 lbs that I did really have to lose...

    I came home after being out on the road 5 1/2 months... my family and friends were shocked and worried at the weight I lost and how obviously exausted I was.. my older brother picked me up to take me to lunch but i stead took me to the doctor.. I was anemic and malnurished..

    Well, needless to say my family and friends wanted me to quit rignt then and there... but, I couldnt.. cause the company was behind on paying me and in my malnurished anemic mind.. if I quit I stood no chance of getting paid for all the hard work that took such a toll on me.. and I couldn't turn them in because I had be faking my logs...

    Well.. I went back out and conditions got worse.. they asked me to team with this other driver for a load.. well ne was a freak and off his rocker.. and they were just keeping us out...

    Well, finally I just couldnt do it any more.. didnt even care if they paid me.. so I got out at a truck stop.. called my brother who came and got me right away.. he left as soon as I called..

    I took a couple weeks to just restore myself to sanity and so I could think straight..

    It took a lot of phone calls and crap but I did finally get most of what they owed me.. and the rest just wasnt worth the hassle...

    Even though I was away from that company and went with a mega.. I still worried that they would get audited and my fake logging would rear up and kick me down...

    So, I talked to some people and then with the aid of a lawyer turned myself in to DOT for falsifying my logs..

    I recieved no charges, fines, or penalties for my false logs...

    I did not keep up what if anything DOT did... nor did I file any claims as I just wanted it all behind and to move forward...

    You hired and paid a lawyer to turn yourself in and confess your HOS violations and illegal logs?

    Wow..Is there a way to save this post as a sticky?..no one that I know is gonna ever believe this?

    Lawyers are allowed in small claims court. Who do you think is setting in the chair on the other side when the bill collector comes calling? It isn't the bill collector. Small claims is just that with 2 parties and the judge. the parties can either represent themselves or have a lawyer do it for them. The problem with a lawyer is finding one who is willing to do it at a price you are willing to pay.

    Take a life insurance policy out on him and forward him a copy of the policy? Also demand you be paid what you are owed. Nothing illegal about that.

    You are correct in most cases, I stand corrected.

    I’m from Michigan and in Michigan you cannot have a lawyer represent you in a small court hearing. There are a few other states where that I true as well but it seems most states do allow them.

    With the limitations of awards in a small claims court it would not seem to be cost effective anywhere though.

    the lawyer is to get my paychecks. This happened 3 days after payday and he would not hand over my previous check. and the exact end of the situation is he instructed me to do a load that would put me over the legal hours again, I refused and that is what pissed him off and fire me. I did not sign any quit form and that is the reason he is not paying me, his terms were sign this or no check, and he has no right to. The advice I was asking for is to get help to bury him and get my money. stated above that I was slow and what not, the problems I created is that he made some promises to a customer to deliver the cars on a certain day and then the next day I told him I was out of hours and could not perform in a safe manner and I was going to park. Thats when his attitude went down hill, but it just made my life ####tier! It did help me get out of the situation sooner.
