This sound kinda messed up! First question I would ask is, are his trucks leased on to a carrier or is he under his own authority? It makes a big difference in how/what you'll be paid. If he's leased to someone you need to make sure your being paid off the gross to the company he's leased to not the gross to the truck. I'll explain..... A load pays $100 His trucks get paid say 75% =$75. Is your 40% gonna come from the $100 or the $75? If he says the $75 tell him have a nice day and walk away from the deal. I would also be concerned about the 40% after fuel. Your cut shouldn't be after he pays for the fuel. Now if he is talking fuel surcharge then I can understand as you don't get a cut of that. Quick math here so it may be somewhat wrong but you hopefully will get my point. $500 load times 30%= 150 $500 load going 250 miles at 6mpg comes out to about 42 gallons times $3.159= $132.68. Now subtract that 132.68 from $500=367.32x40%= $146.93. See you losing $3.07. The number will vary depending on the pay of the loads. Being that your deadheading back I would hope the freight is paying better than $2 a mile. Ok now the 1099 is not illegal, unless you are being treated like an employee (i.e being told when to work and where to go).
The O/O has trucks with different companies, the one in Columbus (Delaware actually) Is dispatched from the Kroger plant. The company he will sign me on with is Greatwide. The other offer from the same O/O is flatbed with www.coshoctontrucking.com Same deal %40 after the fuel, and home weekends. I get the truck and he said I can run as I see fit, within reason of course , so if I want to take monday off I can.
Contact coshocton trucking themselves they are looking for drivers. They pay by the mile and don't pay on a 1099.
If you sign a contract with him it is completely legal... contract labor.. you are not an employee...

Funny you should say that , because I applied to them earlier today. The thing to understand is that almost all companies I talk to want 6months OTR in the past 36 months, and I have been with the same company "local" since 2007
