Judge certifies class in short mile case against Swift Transportation

    I've found there's probably a discrepancy of about 6% with the way my current company routes miles.
    I'm not concerned though because I get hourly inside a 150 mile radius and there a plenty of other bonuses that comp out for a few miles.

    USA the discrepancy was often more like 12%-17% :biggrin_25521:

    I got back at them by taking the scenic route. Didn't stay long enough to get caught.

    Sadly this case will probably be bogus.

    1.) it's over 10 years old already. How much money in court costs have been blown already.

    2.) now that it's a class-action suit concerning over 62 thousand drivers most drivers won't see much more than $100 for the effort.

    3.) the lawyers will get the majority of the money anyway.

    4.) Any award significant enough (lost wages x 2 x 62,000) would probably bankrupt even the largest carrier. So another 120k drivers go out on the bread line.

    5.) Or they just declare chapter 11 (7?), reorganize and stiff all their creditors. Then start over.





    If there was any real justice they'd just use the paper-trail to figure out which execs made the call in the first place and see how much they personally profited from those decisions. Then re-possess any/all assets until parity is reached.

    Driver gets a decent wage and some guy has to give up Corvette, Jetski & ex-wife collection.

    I thought the main point in this lawsuit was that Swift shorted drivers by about 10% but was charging customers exact miles. That means that Swift has/had the means to pay based on actual miles but pocketed the difference.

    Well in that case I hope the trail attorneys don't screw this up.
    Could you imagine what a bad precedent an acquittal will set?

    Not swift but have recently found that Schneider household movers guide miles may not be correct either as they flow to the work orders. Opens a new can of worms.

    P&G Tunkhannock/Mahoopany pa...work order said paid miles for route was 142... navigation said route miles was 192.. contacted leader to look up paid miles and got a response of 172. Asked to have work order corrected. Told no and that i didnt understand i had to use the household movers guide and it pays 172 miles.

    Asked to have work order corrected... told no disputed it to no avail...when I got my pay detail it paid 157. Other drivers said is a big problem every route is 30 miles short on pay and schneider wont fix it. Sorry but your getting screwed more than you know if Schneider is doing it so is swift. Just imagine the back pay for a major account like P&G. Just buy stock in lub I guess.

    This is a thing that happens.

    I am paid on practical miles, not HMG, but they still want me going out-of-route for fuel sometimes. If it's reasonable, I'll do it, but if it's going to add more than about 10 miles overall, I call and tell them to either re-route me or change the fuel stop. Usually they just change the fuel stop, I guess that's easier for them.

    The problem with both PM and HMG is if you're a fairly spread-out city that's annexed many/all of the suburbs (say, Columbus) and you deliver on the north side, within city limits, then are sent to pickup on the south side, also within city limits...you may have to drive 15-20 miles...and you get paid for 0 miles, because you are already in Columbus and the guide goes by post office to post office only.
