How is Swift liable for funds a driver that quit CRST to work at Swift ? Isnt the individual driver responsible for their debt? This case will be repealed, I think.
MartinFromBC, Aamcotrans, FlaSwampRat and 1 other person Thank this. -
If this ruling stands, it will be like indentured servitude. Nobody will hire you until your contract is up unless they want to pay millions in a lawsuit and the driver will be stuck there.
Aamcotrans, FlaSwampRat and x1Heavy Thank this. -

They can get a job anywhere they want. They just need to meet one of two conditions.
One. Get a non driving job.
Two. Pay off the loan.
They willing entered into the contract to get their CDL "for free". They should be held to the contract.FlaSwampRat Thanks this. -
Does the contract have a non-compete clause? If so, then hopefully people are aware of that before they sign on.FlaSwampRat Thanks this.

Swift got sued for interfering with the contracts CRST had with their drivers.
I agree it's a bad verdict.Dale thompson Thanks this. -
The vast bulk if the contract is a non compete clause. The whole point is to force the driver to pay for the schooling they received. CRST doesn't care if it's in cash or time, just that they get paid.
P.S. They should know, and would if they actually read the contract, or better have a lawyer read it. Doesn't mean they did though.FlaSwampRat Thanks this. -

That makes zero sense.
Employee A walks out on a contract with Company B and hires on with Company C
Why the hell would Company C *EVER* be liable for that????
Or are they going after Swift's advertised "tuition reimbursement"??? In that case... uhm, yeah, fair enoughFlaSwampRat Thanks this.
