Just some of the stupid things I see

    Wow! I haven't heard the old "5th Amendment" line in a long time, maybe 8 or 10 years.

    Same with the "US Marshall" threat.

    Those are oldies but goodies, like the old "I get 15 minutes to catch my log book up" line. I am still looking for the statute on that one.

    Some trucker was sitting in the greasy spoon going on the other day about US Marshals and ALL that they had done for him. This guy was so convincing I think even he was believing his own BS.

    All you can do is laugh when you hear these mental midgets start spouting off.

    Being required to provide testimony (logbook) that will be used against you by the government does seem to me to be a fifth amendment violation.

    As far as catching up your logbook, the only thing I've seen that may allow something like that is 395.13 (3) Exception. A driver failing only to have possession of a record of duty status current on the day of examination and the prior day, but has completed records of duty status up to that time (previous 6 days), will be given the opportunity to make the duty status record current.

    This is under Drivers declared out of service so maybe you still get a logbook ticket but not put out of service if you can get your book caught up and it is within HOS limits. Doesn't say anything about 15 minutes to do it though.

    We don't have rights while driving a CMV. As you know, driving is a privilege and driving a CMV is a greater privilege that demands certain rights be forfeited for the safety of everyone else on the roads.
    My main point of contention with this reality is simple. Why are only CMV drivers held to this standard? Statistically we are far safer drivers that cause fewer accidents, deaths, injuries, and property damage. If these rules and regulations are genuinely there for public safety, then shouldn't ALL USERS of public roads be held to the same high standards, pay the same consequences, and surrender their personal rights while driving as well???
    Just imagine the effect it would have on society as a whole if four wheelers were subject to drug testing, fatigue rules, and all the Bravo Sierra rules that truckdrivers had to obey?
    Safer roads for the safety groups and for our lawmakers, A BRAND NEW SOURCE OF UNTAPPED REVENUE!!!
    Just imagine all the Bravo Sierra tickets that could be wrote up and given to the millions of cars every year.

    Possesion of a CDL does not void Fourth and Fifth Amendment rights!

    Possession of a badge and a gun do not give any person the right to trample the Constitutionally guranteed rights of another person! Benjamin Franklin and Thomas Jefferson are rolling over in their graves!

    This is taught in Basic Police Academy. Log books are not included in the Fifth Amendment.
