They are required to be in the truck and in working order, whether they actually get used or not.

If your buddy is being obstinate, checking for the presence of the restraint allows the DOT officer access to the inside of the truck (where anything openly visible is fair game to catch his eye) without needing to receive any form of consent from the driver, carrier, or truck owner prior to the search.

Nope you can't remove it...but you can tuck it under your bunk!

Please read (slowly if necessary), nowhere in this regulation does it say that the device must be used by the occupant...it only states that it must be present and meet certain, minimum standards, and be in proper working order!
    NEXT CASE!:biggrin_25514:

ps...AND W900...now that you are slim trim and ready to eat again...the 6k force threshold might possibly hold you in the bunk...unless Cat tosses you out to the catwalk for the night! Please refer to post #140...this confirms my original argument from that post!

Are you telling ME to read it slowly? :biggrin_2552:

I'm pretty sure I have a firm grasp on what the reg states....after all, I'm the one who wrote whether they actually get used or not.

Hey hey Hey, Can we get this thread back on subject? There are plenty of threads about where the trainer should be and shouldn't be, There are several of you here that have taken this thread and several others in the wrong direction, I wonder if you would not be to happy if that happened to your thread, Now Dieselbear is a nice guy and I'm sure he doesn't care about where this goes but I like to be able to come to this thread and get a WOW without the regulations as to where the trainer should be. Please don't flame me as I don't need it. I just think this ship needs headed in the right direction. Thank You for your understanding in this matter!!. TD

It's just a conversation, and as with any conversation, one thing leads to another, which sparks a thought which runs off in it's own direction until eventually you are left scratching your head trying to figure out where it started and how you ended up where you are. The difference is, on the internet, you can go back and read through the thread again to remind yourself how we got here from there. The other good thing about the internet is that you can put it away for a while when you have things to do and pick it up later when you have time again and not really miss much. Sure beats realizing that the "quick cup of coffee" you went in for turned into a 4 hour conversation with a handful of folks you had never met before and may never see again.....

.....and that you are now running 3 1/2 hours behind schedule!:biggrin_2556:

I hate it when that happens.:biggrin_25521:

TD it's ok. I only post on this when I see something on the side of the interstate that I think some of you will just shake your head. The steering wheel holders I refer to are numerous and some are oblivious to the fact that they have no business calling themselves driver's. So as I find these fellas and shake my head in disbelief from what I just saw, I'll continue to post their trials and tribulations for the real driver's humor. For when your having a bad day, a steering wheel holder somewhere is having one much worse when I find him doing stupid stuff.

As for the bunk restraint..never had mine checked! Always kinda wondered what good it would do if im a solo driver....but its still required! Even in a truck with a single bunk! How ya gonna team drive in that with a stranger?

I did have the DOT in Virginia look at my seatbelt though, which is required on a level 3 inspection...but most cops dont do that. He asked me if my door was locked, before i even answered it was open...scared me! Took a lil look and handed me my papers and with kind of a dissapointed look, said....just be careful pulling back out on the road!...they were basically pulling trucks off into this big inspection slot on the side of US-58, and checking logbooks...i didnt have one....pissed him off..haha.

get special tickets that have an ad for the forum printed on them...

"Think im a dumb arse for writing this ticket? Argue about it at thetruckersreport.com/truckingindustryforum/!!!!!!!"

    hahahaha imagine the drama!

He already said he inspects people for speedin. He also already said he inspects people on non-interstates. dont take much to speed by accident, going downhill, fully loaded, on a us route...

hehehe the last day i was in training at CRST, my trainer got pulled over for speeding. was talking on his cell phone doing 70, went into a 55 zone in kentucky, DOT was sitting at the ramp about 1/4 mile from the speed limit change..as soon as he saw him there he realized he was busted.....

DOT was cool, he hadnt drawn any lines at all for the day, didnt give him any tickets other than speeding, marked down to 5 over...hah...but he did get inspected. I suppose that'd never go over so easily with DB...
