Elect judges who hold strict adherence to the Constitution above whatever precedent has been set by previous courts. If a judge uses precedent to justify a decision which runs counter to the Constitution, vote them out. In the case of appointed judges, elect chief executives (president, governor, etc.) who will appoint judges who base their decisions on the Constitution.

Elections have consequences. If we the people elect politicians who view the courts as their end-run around the legislature in order to enact policies which would not pass into law through the normal channels, we end up with activist judges who use their position to push their agenda. However, if we the people elect politicians who view the judiciary as the check & balance on the legislative & executive branches in an effort to keep the government operating within the scope of the Constitution, then we get strict constructionist judges on the courts who ensure any legislation that is passed into law are actually Constitutional.

I disagree. First, read the Constitution for yourself so that you know what it says. Then come election time, educate yourself as to the various positions each candidate takes and vote for the candidate who has formed his/her political positions based upon what is actually written in the Constitution, instead of voting for candidates who form their position and then have to interpret the Constitution to justify the position they wish to take.

Well I wouldn't call the few from the last week or so drivers, maybe steering wheel holders. Some stupid stuff like not having endorsements, false logs, operating without CDL's. Everybody else had most of their stuff in order.

you haven't seen a dude in a red suit driving a sleigh making a couple trial runs, maybe with an out of date safety inspection sticker? :)

DB, given the strength of CSA, and the rules regarding having all necessary endorsements before you start a truck.
It surprises me that ANY company willingly puts a driver on the road, without verifying ALL CDL information.
To include class, and endorsements, as well as health card status. Do you find this to be a trend? Or is it more likely that someone lied to their employer?

We have several violations for med cards and endorsements. Seems the carrier previously hired some drivers with just CDL as we had some freight like that and lost track and dispatched them on hazmat.

Same with med cards....... no one watching the files.

But CSA is working, seriously..... we have been denied business because of our score and threatened by others...... got good attention from the uppers.

You are thinking like a trucking professional. These fellas are not professionals. I don't think it is a trend, I think it is some that think they can just get a truck and go out and run the wheels off of it.

I've got a local company that has little trucks that are used in the performance of a business. A two truck operation, just used when needed to haul whatever is needed. The truck got stopped and had every violation known to us in enforcement. Driver suspended. no medical card, no carrier name or DOT number, no safety equipment etc...... A month later I get the same driver in the same truck, this time the owner re-registered the vehicle in his personal name thinking this would get him around the regs. Still everything is wrong, driver still suspended and nothing has been corrected. Some will do whatever they can to re-invent the wheel. :biggrin_25512:

I would hope not, he's putting everyone around him in grave danger by not having an up-to-date sticker. However he's going to be out of business anyway because some pencil pusher in Washington is cutting his HOS, no way every kid can get toys and keep a legal log book.:biggrin_25525::biggrin_2559:
