And who determines what "vicinity" will include? It is these broad regulations that leave the "intent" of the law open to mis-interpretation.
So just where IS the "black and white" on this? -

Seems clear enough to me. 1. You can be going to your home with no cargo and no dispatch. 2. You can be going from your home to your terminal with no cargo or dispatch. 3. You can leave the location that your using for your break for personal needs but, you must return to the same location to complete your break. I don't see where any other use is authorized. Per the dictionary, unladen is defined as no cargo. If your manifest shows the trailer is your cargo, then you can't pull it. Otherwise, the empty trailer may be attached. Keep in mind that when you find someone who needs to define what "is" is you may still have a problem.
