Well, if you all want to get technical about it, you can be under dispatch while BT. How many drivers are running all over hell's half acre looking for an MT, to go make their pickup? That's under dispatch. And not laden.

Until a clear cut definition is added to 395 that defines personal conveyance, there will always be multiple opinions on this. Some say with empty trailer is laden, so say it is not. What is a short distance to me, may not be short to the next guy. Over the years I have seen someone claim this only a few times.

Yep! Definitely a "given an inch, took a mile" kind of thing.

There was a driver over on the Twuck.Nut a few years ago that was just like the guy you caught. Thought it perfectly reasonable to deadhead cross-country on conveyance every trip, because "I'm going to the house!" Argued endlessly with the LEO over there, and any attempt at reason was a futile venture.
I hope it was him you nailed (Although you know how it goes, he'll be right back to doing it again, because you don't know what you're talking about!):biggrin_2559:

The vehicle is being driven for a business purpose in this scenario... that's certainly outside of "personal conveyance."

Uh huh. And we all know what opinions are like. . .

How do you figure on duty NOT driving? Where does that come from if you are BT around looking for a trailer?

In a secured lot? Yes. On the street? No.
